The Veterinary Surgery (Exemptions) (Amendment) Order 1982

The Minister of Agriculture, Fisheries and Food, the Secretary of State for Scotland, the Secretary of State for Wales and the Department of Agriculture for Northern Ireland, acting jointly, in exercise of the powers conferred by section 19(4)(e) of the Veterinary Surgeons Act 1966(1) and now vested in them(2) and of all other powers enabling them in that behalf, after consultation in accordance with the said section 19(4)(e) with the Council of the Royal College of Veterinary Surgeons, hereby make the following order:-

Title and commencement

1. This order may be cited as the Veterinary Surgery (Exemptions) (Amendment) Order 1982 and shall come into operation on 1st January 1983.

Amendment

2. The Veterinary Surgery (Exemptions) Order 1962(3) shall be amended as follows:-

(a)in Article 4(d) for the words "a suitable instrument;" there shall be substituted the words "a suitable instrument, unless the poult has reached the age of 21 days;"; and

(b)in Article 4(e) for the words "a suitable instrument; and" there shall be substituted the words "a suitable instrument, unless, in the case of the removal of a comb, the fowl has reached the age of 72 hours.".

EXPLANATORY NOTE

This Order amends the Veterinary Surgery (Exemptions) Order 1962 by providing that:-

(i) the removal of the snood of a turkey which has reached the age of 21 days and

(ii) the removal of the comb of a fowl which has reached the age of 72 hours

can no longer be carried out by a layman. The operations must now be carried out by a veterinary surgeon.

section 27(1) was amended by article 11(2) of, and paragraph 1 of Schedule 5 to, the Transfer of Functions (Wales) (No. 1) Order 1978 (S.I. 1978/272).

By virtue of the order mentioned in footnote (a); and, in the case of the Department of Agriculture for Northern Ireland, by virtue of section 40 of, and paragraph 7(1) of Schedule 5 to, the Northern Ireland Constitution Act 1973 (c. 36) and section 1(3) of, and paragraph 2(1)(b) of Schedule 1 to, the Northern Ireland Act 1974 (c. 28).
