The Secretary of State for Transport, in exercise of powers conferred by section 5(3) and (4) of the Transport Act 1981 and, in the case of Article 2, with the consent of the Treasury, hereby makes the following Order:-
1. This Order may be cited as the Associated British Ports (Appointed Day and Designation of Holding Company) Order 1982 and shall come into operation on 31st December 1982.
2. 31st December 1982 is hereby appointed for the purposes of the said section 5.
3. Associated British Ports Holdings Limited (being a company limited by shares, formed and registered under the Companies Act 1948, in which all the issued shares are held by the Secretary of State or by nominees for him) is hereby designated as the Holding Company.

This Order:-
(1) appoints 31st December 1982 as the appointed day for the purposes of section 5 of the Transport Act 1981, that is to say, as the day on which the British Transport Docks Board is reconstituted under the name of Associated British Ports and as from which a company (the "Holding Company") formed and registered under the Companies Act 1948 (c.38) will have, by virtue of Part II of the Transport Act 1981 (c.56), powers in relation to Associated British Ports corresponding to the powers of a holding company over a wholly owned subsidiary; and
(2) designates Associated British Ports Holdings Limited as the Holding Company mentioned above.
