PUBLIC PASSENGER VEHICLES

The Public Service Vehicles (Conditions of Fitness, Equipment, Use and Certification) (Amendment) Regulations 1984

The Secretary of State for Transport, in exercise of the powers conferred by sections 52(1)(a) and 60(1) of the Public Passenger Vehicles Act 1981, and of all other enabling powers, and after consultation with representative organisations in accordance with section 61(2) of the said Act 1981, hereby makes the following Regulations:-

1. These Regulations shall come into operation on 1st January 1985, and may be cited as the Public Service Vehicles (Conditions of Fitness, Equipment, Use and Certification) (Amendment) Regulations 1984.

2. The Public Service Vehicles (Conditions of Fitness, Equipment, Use and Certification) Regulations 1981(1) are amended in accordance with the following provisions of these Regulations.

3. For Regulation 46 (Applications and fees for certificates of initial fitness) substitute the following Regulation:-

"46.-(1) Every application for a certificate of initial fitness shall be made to the Secretary of State at the PSV Centre, Welcombe House, 91-�92 The Strand, Swansea SA1 2DH and on a form to be obtained from him.

(2) The prescribed fee for a certificate of initial fitness is-

(a)on the first application, £88, and

(b)on any subsequent application-

(i)£88 if the testing which that application will require consists of or includes a test to ascertain whether or not the requirements specified in Regulation 6 are complied with;

(ii)£10 in any other case."

4. In Regulation 50 (Fees for type approval)-

(a)in paragraph (a) for "£50" substitute "£554", and for "£5" substitute "£54".

(b)in paragraph (b) for "£25" substitute "£278"; and

(c)in paragraph (c) for "£125" substitute "£1,180".

EXPLANATORY NOTE

1. These Regulations further amend the Public Service Vehicles (Conditions of Fitness, Equipment, Use and Certification) Regulations 1981.

2. These amendments-

(1) substitute for the fee of £35 for a certificate of initial fitness fees for applications for certificates of initial fitness amounting to £88, or £10 depending on the test or inspection which will be required (Regulation 3);

(2) substitute for the fees of £50, £5, £25 and £125, for type approval, fees of £554, £54, £278 and £1,180 respectively (Regulation 4); and

(3) provide for applications for certificates of initial fitness to be made to the Secretary of State at the PSV Centre, Welcombe House, 91-�92 The Strand, Swansea SA1 2DH instead of to the traffic commissioners (Regulation 3).
