The Secretary of State for Social Services in exercise of the powers conferred on him by section 92(5) of the National Health Service Act 1977 and of all other powers enabling him in that behalf, in consequence of the apportionment of trust property under section 92(4) of that Act hereby makes the following Order:-
1. This Order may be cited as the National Health Service (Amendment of Trust Instruments) Order 1984 and shall come into operation on 1st April 1984.
2. Where under Article 6(1) of the National Health Service (Determination of Districts) Order 1981 there have been transferred from an Area Health Authority to a District Health Authority as trust property and there have been apportioned investments and moneys which before that transfer constituted a combined pool set up under a scheme specified in the Schedule to this Order or any other similar scheme in respect of other groups of charities (apart from a scheme mentioned in the National Health Service (Amendment of Trust Instruments) Order 1983) that scheme shall be amended so that in respect of those investments and moneys and any accretions thereto references to that District Health Authority shall be substituted for references to that Area Health Authority.
3. For any reference to an Area Health Authority in a trust instrument relating to an investment or sum of money which formed part of any combined pool mentioned in Article 2 of this Order and has been apportioned under Article 6(1) of the National Health Service (Determination of Districts) Order 1981 there shall be substituted a reference to the District Health Authority to which that investment or sum of money has been so apportioned.

2. The scheme for certain charities formerly administered by Sefton Area Health Authority sealed by the Charity Commission on 10th March 1977 and numbered N61(S)77.
3. The scheme for certain charities formerly administered by Manchester Area Health Authority (Teaching) sealed by the Charity Commission on 14th May 1971 and numbered N341 71.
4. The scheme for certain charities formerly administered by Manchester Area Health Authority (Teaching) sealed by the Charity Commission on 7th May 1974 and numbered N133(S)74.
5. The scheme for certain charities formerly administered by Birmingham Area Health Authority (Teaching) sealed by the Charity Commission on 30th March 1979 and numbered N107(S)79.
6. The scheme for certain charities formerly administered by Camden and Islington Area Health Authority sealed by the Charity Commission on 19th February 1975 and numbered 68(S)75.
7. The scheme for certain charities formerly administered by Cumbria Area Health Authority sealed by the Charity Commission on 16th January 1967 and numbered 127/67.
8. The scheme for certain charities formerly administered by Cheshire Area Health Authority sealed by the Charity Commission on 9th March 1976 and numbered N77(S)76.
This Order amends trust instruments in consequence of the transfer of hospital trust property from Area Health Authorities to District Health Authorities by Article 6(1) of the National Health Service (Determination of Districts) Order 1981. It applies to trust property formerly held by Area Health Authorities in combined investment pools and permits District Health Authorities to hold such trust property apportioned to them in combined pools.
