The Local Government Reorganisation (Property) (West Midlands) Order 1987

Whereas the West Midlands Residuary Body, acting pursuant to section 67(2) of the Local Government Act 1985(1), has submitted proposals to the Secretary of State for the transfer of certain property, rights and liabilities to local authorities, and he has decided to give effect to those proposals without modification;

Now, therefore, the Secretary of State, in exercise of the powers conferred on him by section 67(3) of that Act, and of all other powers enabling him in that behalf, hereby makes the following Order:

Citation and commencement

1. This Order may be cited as the Local Government Reorganisation (Property) (West Midlands) Order 1987, and shall come into force on 22nd July 1987.

Specified property

2.-(1) There shall vest in each council mentioned below the property described in column 1 of the Schedule so mentioned in relation to that Council.

(2) Where any property mentioned in column (1) of a Schedule is registered with Her Majesty's Land Registry, the relevant title number is set out in column (2).

3. The two parcels of land at the rear of 65 and 67 George Eliot Road, Coventry, registered with Her Majesty's Land Registry under title numbers WM 298417 and WM 147727 shall vest in Coventry City Council.

4. There shall vest in each council to which property is transferred by article 2 or 3 above all rights and liabilities of the West Midlands Residuary Body acquired or incurred exclusively in connection with that property.

Occupied dwellings

5. All rights and liabilities of the West Midlands Residuary Body in any property acquired or appropriated by the West Midlands County Council for or in connection with its functions relating to highways, streets and bridges and road traffic which at the making of this Order is let or licensed as a dwelling by the council of a district in the county of West Midlands shall vest in that council.

Other property, rights and liabilities

6.-(1) All property, rights and liabilities of the West Midlands Residuary Body in relation to each item mentioned below are hereby transferred to the council mentioned below in respect of that item-�

Coventry City CouncilA debenture dated 17th December 1982 created by the University of Warwick Science Park Limited.
Solihull Metropolitan Borough CouncilShares in Freeports Limited and West Midlands Freeport Limited.
Walsall Metropolitan Borough CouncilThe agreement dated 29th March 1984 between the West Midlands County Council and the Walsall Chamber of Commerce relating to the Training Centre at Willenhall Road, Darlaston.

(2) The shares transferred by paragraph (1) to Solihull Metropolitan Borough Council shall be held by that council for the joint use and benefit of itself and of the other district councils in the county of West Midlands.

7. Where on 1st April 1986 by virtue of section 263 of the Highways Act 1980(2) any highway vested in the council of any district in West Midlands, any interest of the West Midlands Residuary Body in any land below such highway shall vest in that council.

Explanatory Note

(This note is not part of the Order)

This Order transfers certain property, rights and liabilities formerly vested in the West Midlands County Council to the councils of the districts in that County.

Article 3 transfers two parcels of land to Coventry City Council and article 4 makes provision for the transfer of rights and liabilities in relation to land transferred by article 2 or 3.

Article 5 transfers dwellings held by the abolished County Council for highways and other connected purposes and let or licensed by the district council.

Article 6 makes miscellaneous transfers of property, rights and liabilities. Copies of any document referred to in that article can be inspected at the offices of the transferee council, and at the offices of the West Midlands Residuary Body, 1 Lancaster Circus, Queensway, Birmingham B4 7DJ.

Article 7 transfers any interest of the West Midlands Residuary Body in the sub-soil of highways to the relevant highway authority.

1980 c. 66. On 1st April 1986, by virtue of section 8 of and Schedule 4 to the Local Government Act 1985, metropolitan district councils became highway authorities for their areas, and by virtue of section 263 the highways vested in such councils.
