HIGHWAYS, ENGLAND AND WALES

The (A168) Boroughbridge-Thirsk Trunk Road (Dishforth Interchange, Slip Roads and Link Roads) Order 1987

28th August 1987

The Secretary of State for Transport makes this Order in exercise of powers conferred by sections 10 and 41 of the Highways Act 1980(1), and now vested in him(2), and of all other enabling powers:

1. The new highways which the Secretary of State proposes to construct, at Dishforth, in the County of North Yorkshire -�

(a)along the route described in Schedule 1 to this Order (the highway along this route being in this Order referred to as "the main new trunk road"),

(b)along the routes described in Schedule 2 to this Order which connect the Trunk Road with other highways at the places stated in that Schedule (the highways along these routes being in this Order referred to as "the A1 slip roads"),

(c)along the routes described in Schedule 3 to this Order which connect the main new trunk road with other highways at the places stated in that Schedule (the highways along these routes being in this Order referred to as "the link roads"),

shall become trunk roads as from the date when this Order comes into operation.

2. The centre lines of the new trunk roads are indicated by heavy black lines on the deposited plan.

3. The Secretary of State directs as respects any part of a highway which crosses the route of any of the new trunk roads that -�

(a)where the highway is a highway maintainable at the public expense by a local highway authority, the part in question shall be maintained by that authority, and

(b)where the highway is not a highway so maintainable and is not maintainable under a special enactment or by reason of tenure, enclosure or prescription, the Secretary of State shall be under no duty to maintain the part in question, until, in either case, a date to be specified in a notice given by the Secretary of State to the highway authority for that highway. The date specified will not be later than the date on which the relevant route is opened for the purposes of through traffic.

4. In this Order -�

(1) all measurements of distance are measured along the route of the relevant highways;

(i)(2) "the deposited plan" means the plan folio, containing one plan, numbered HA 10/CNE98, marked "The (A168) Boroughbridge-Thirsk-Trunk Road (Dishforth Interchange Slip Roads and Link Roads) Order 1987", signed by authority of the Secretary of State and deposited at the Department of Transport, Romney House, Marsham Street London SW1P 3PY.

(ii)"The Trunk Road" means the A1 London-Edinburgh-Thurso Trunk Road.

(iii)"the new trunk roads" means the highways referred to in article 1 of this Order.

5. The Boroughbridge-Thirsk Trunk Road (Dishforth Link Interchange and Slip Roads) Order 1986(3) is hereby revoked.

6. This Order shall come into operation on £xp22nd September£ap 1987 and may be cited as the (A168) Boroughbridge-Thirsk Trunk Road (Dishforth Interchange, Slip Roads and Link Roads) Order 1987.

SCHEDULE 1THE ROUTE OF THE MAIN NEW TRUNK ROAD

The route of main new trunk road starts at the junction of the Trunk Road (A168) with the unclassified County Road (SK 15G) known locally as Blind Lane (marked "A" on the deposited plan) and proceeds south westwards for 178 metres (to a point marked "B" on the deposited plan) where the route bifurcates, one bifurcation proceeds south south-westwards for 556 metres and then southwards to connect with the southbound carriageway of the Trunk Road (A1) (at a point marked "C" on the deposited plan), the other bifurcation proceeds south-westwards for a distance of 978 metres to connect with the northbound carriageway of the Trunk Road (A1) (at a point marked "D" on the deposited plan).

SCHEDULE 2ROUTES OF THE A1 SLIP ROADS

1. A route (numbered 1 on the deposited plan) to connect the northbound carriageway of the Trunk Road (A1) with the link road described in Schedule 3 to this Order and numbered 3 on the deposited plan.

2. A route (numbered 2 on the deposited plan) to connect the southbound carriageway of the Trunk Road (A1) with that link road.

SCHEDULE 3ROUTES OF THE LINK ROADS

1. A route (numbered 3 on the deposited plan) to link the slip roads described in Schedule 2 to this Order with the eastbound carriageway of the Trunk Road (A168) at the point marked "E" on the deposited plan.

2. A route (numbered 4 on the deposited plan) to link the route given the reference number 3 on the deposited plan with the westbound carriageway of the Trunk Road (A168) at the point marked "F" on the deposited plan.
