The Anglian Water Authority (Tunstead) Order 1987

Made

14th October 1987

Coming into force

15th October 1987

The Secretary of State for the Environment, in exercise of the powers conferred by sections 23, 32(1) and 59(1)(1) of the Water Act 1945(2) and now vested in him(3) and of all other powers enabling him in that behalf, hereby makes the following Order:-

Citation and commencement

1.-(1) This Order may be cited as the Anglian Water Authority (Tunstead) Order 1987 and shall come into force on 15th October 1987.

(2) This Order shall be included among the enactments which may be cited together as the Anglian Water Authority Act and Orders 1974 to 1987.

Interpretation

2.  In this Order-

"the Authority" means the Anglian Water Authority;

"the deposited plan" means the plan prepared in duplicate, signed by an Under Secretary in the Department of the Environment and marked "Plan referred to in the Anglian Water Authority (Tunstead) Order 1987", one duplicate of which is deposited and is available for inspection at the offices of the Authority at Yare House, 62/64 Thorpe Road, Norwich and the other at the offices of the Secretary of State for the Environment;

"the Third Schedule" means the Third Schedule to the Water Act 1945;

"the undertaking" means the undertaking of the Authority as for the time being authorised by any enactment.

Power to acquire, continue and maintain works

3.  The Authority may acquire by agreement and thereafter continue and maintain the mains, pipes and apparatus the approximate positions of which are shown by continuous and broken blue lines on the deposited plan.

Works to form part of the undertaking

4.  The mains, pipes and appartus acquired by the Authority in pursuance of this Order shall for all purposes form part of the undertaking and for the purposes of the Third Schedule as applied to the undertaking shall be deemed to have been laid or constructed by the Authority for the purpose of giving a general supply of water.

Application of section 94 of the Third Schedule

5.  Section 94 of the Third Schedule shall apply to the undertaking and is hereby incorporated with this Order, subject to the modification that in subsection (1)(4) for the words from "metropolitan district" to the end of the subsection there shall be substituted the words "and non-metropolitan district affected by the special Act".
