The Secretary of State for Transport, having consulted the persons referred to in section 15A(4) of the Harbours Act 1964(1), in exercise of the powers conferred upon him by section 15A of that Act and all other powers enabling him in that behalf hereby makes the following order:
1. This Order may be cited as the Harbour Authorities (Teignmouth) (Constitution) Order 1987 and shall come into force on 20th March 1987.
2. The Teignmouth Harbour Order 1924(2) shall be amended as follows-
(1) Section 7(1) shall be replaced by the following-
"(1) (a) the Teign Watermen's and Fishermen's Association may, after consulting the Chairman of the Commissioners, appoint one member; and
(b)the Royal Yachting Association may, after consulting the Chairman of the Commissioners, appoint one member;".
(2) Section 8(2) shall be amended by substituting for the words "the first five subsections of section 7" the words "subsections (2) to (5) of section 7".
(3) After section 8(2) there shall be added the following sub-section-
"(2A) The persons appointed under sub-section (1) of section 7 (as amended by the Harbour Authorities (Teignmouth) (Constitution) Order 1987) shall take office as follows-
(a)the persons first appointed shall take office on 17th September 1987 and shall hold office until the end of the third Thursday in September 1990.
(b)the persons appointed subsequent to the first appointments shall take office on the day following the third Thursday in September 1990 and in every third subsequent year and are to go out of office at the end of the day before the day on which their successors take office.
Provided that retiring members shall be eligible for reappointment".

Section 15A of the Harbours Act 1964 enables Orders to be made abolishing the power of appointment by Ministers of members of harbour authorities; or providing for such power to be exercised by some other person.
The Minister's powers of appointment are to be exercised by other people in respect of Teignmouth Harbour Commission.
