BRITISH NATIONALITY
Made
31st March 1987
Laid before Parliament
9th April 1987
Coming into force
30th April 1987
Whereas I consider service under the Agricultural and Food Research Council and service on secondment from the Medical Research Council, the Science and Engineering Research Council, the Natural Environment Research Council and the Agricultural and Food Research Council to be closely associated with the activities outside the United Kingdom of Her Majesty's Government in the United Kingdom;
Now, therefore, in exercise of the powers conferred upon me by section 2(3) of the British Nationality Act 1981(1), I hereby make the following Order:
1. This Order may be cited as the British Citizenship (Designated Service) (Amendment) Order 1987 and shall come into force on 30th April 1987.
2. In the Schedule to the British Citizenship (Designated Service) Order 1982(2) (which specifies descriptions of service designated for the purposes of section 2 of the British Nationality Act 1981) after paragraph 11 there shall be inserted the following paragraphs–
"12. Service under the Agricultural and Food Research Council.
13. Service in pursuance of an appointment outside the United Kingdom in respect of which the person concerned is on secondment from service under any of the organisations specified in paragraphs 9, 10, 11 and 12 of this Schedule. For this purpose, a person is on secondment from service under such an organisation if, having been serving under such an organisation, he is for the time being in temporary service under arrangements whereby he is to return to service under that organisation when that temporary service ends.".
Douglas Hurd
One of Her Majesty's Principal Secretaries of State
Home Office
31st March 1987
(This note is not part of the Order)
Section 2 of the British Nationality Act 1981 provides, inter alia, that a person born outside the United Kingdom after commencement of the Act is a British citizen if at the time of the birth his father or mother is a British citizen and is serving outside the United Kingdom in service designated by the Secretary of State, recruitment for that service having taken place in the United Kingdom. Various types of service are designated for the purposes of this provision by the British Citizenship (Designated Service) Order 1982.
This Order amends that Order so as to include, in the types of service so designated, the various types of service specified in Article 2.
