The Local Government Reorganisation (Property) (South Yorkshire) Order 1987

Whereas the South Yorkshire Residuary Body, acting pursuant to section 67(2) of the Local Government Act 1985(1), has submitted proposals to the Secretary of State for the transfer of certain of its properties to local authorities, and he has decided to give effect to those proposals without modification:

Now, therefore, the Secretary of State, in exercise of the powers conferred on him by section 67(3) of that Act, and of all other powers enabling him in that behalf, hereby makes the following Order:-

1. This Order may be cited as the Local Government Reorganisation (Property) (South Yorkshire) Order 1987 and shall come into force on 5th May 1987.

2. There shall vest in each council mentioned below the property described in the Schedule so mentioned in relation to that council, together with all rights and liabilities acquired or incurred exclusively in connection with that property-

3. Where on 1st April 1986 by virtue of section 263 of the Highways Act 1980(2) any highway vested in any council mentioned in article 2 above, any interest of the South Yorkshire Residuary Body in any land below such highway shall vest in that council.

SCHEDULE 1PROPERTY IN BARNSLEY TRANSFERRED TO BARNSLEY METROPOLITAN BOROUGH COUNCIL

1. The Barnsley Main Phase I and Phase II Derelict Land Reclamation Sites, Oaks Lane.

2. The Worsbrough Branch Railway Derelict Land Reclamation Site, Smithley Lane, Wombwell.

3. The Dearne Valley Railway Derelict Land Reclamation Site, Goldthorpe.

4. No. 4, Upper Sheffield Road.

5. No. 7, Upper Sheffield Road.

6. No. 189, Sheffield Road.

7. The Penistone Highways Depot, Springvale, Sheffield Road, Penistone.

8. The Barugh Green Highways Depot, Barugh Lane, Barugh.

9. The site of No. 36, Cemetery Road.

10. The Cooper Art Gallery and No. 10, Eastgate.

SCHEDULE 2PROPERTY IN DONCASTER TRANSFERRED TO DONCASTER METROPOLITAN BOROUGH COUNCIL

1. Bullcroft Colliery Reclamation Site, Skellow Road.

2. Bentley Highways Depot, Watch House Lane and Queens Drive, Bentley.

3. Edlington Highways Depot, Oakland Terrace, New Edlington.

4. Wadworth Highways Depot, Church Road, Wadworth.

5. Hatfield Highways Depot, Doncaster Road, Hatfield.

6. The Carcroft Common Industrial Estate.

7. The former British Mohair Spinners factory premises and adjoining land at North Eastern Road, Thorne.

8. No. 96, North Eastern Road, Thorne.

SCHEDULE 3PROPERTY IN ROTHERHAM TRANSFERRED TO ROTHERHAM METROPOLITAN BOROUGH COUNCIL

1. The M1 Motorway Screen areas at Brinsworth.

2. The Environmental Improvement Site on the west side of Canklow Road.

3. The site of the former Ravenfield Tip, off Hollings Lane, Ravenfield.

4. That part of Waleswood Colliery Reclamation Site which is shown as Parcel 1577 on Ordnance Survey Map Sheet SK4683-4783.

5. That part of Station Road, Catcliffe which extends from its junction with Frederick Street in a westerly direction, together with the land lying to the south of that part and abutting the Brinsworth to Treeton railway line.

6. No. 46, Aldred Street.

7. No. 48, Aldred Street.

8. No. 9, Garfield Mount.

9. No. 61, Clifton Lane,

10. No. 63, Clifton Lane.

11. Lockup shop No. 123 and the sites of Nos. 111, 113, 115, 117 and 143 Fitzwilliam Road.

12. The Wentworth Craft Workshops, Hague Lane, Wentworth.

14. The Highways Depot, known as Wath Parr Yard, Wath.

16. The highway improvement land fronting Nos. 59, 61 and 63, Clifton Lane.

17. The highway improvement land fronting No. 33, Aldred Street.

18. The sites of Nos. 65, 65A and 67, Clifton Lane, and the highway improvement land to the rear of those sites.

19. The site of No. 69, Clifton Lane, and the highway improvement land lying to the south west and to the east of it.

20. No. 36, Badsley Moor Lane.

21. The land held for highways purposes which is situated at the north-eastern corner of No.95, Main Street, Bramley.

SCHEDULE 4PROPERTY IN SHEFFIELD TRANSFERRED TO SHEFFIELD CITY COUNCIL

1. The Environmental Improvements Site, Eastwood Road, Sharrow Vale.

2. The Environmental Improvements Site, Thirza Street, Owlerton.

3. The Environmental Improvements Site situated in Wood Street and Penistone Road, Owlerton.

4. The Environmental Improvements Site, on the site of No. 4, Spital Hill.

5. The Environmental Improvements land on the sites of Nos. 10, 12, 14 and 16 Spital Hill.

6. No. 601, Prince of Wales Road.

7. No. 793, Prince of Wales Road.

8. No. 795, Prince of Wales Road.

9. No. 1, Poole Place.

10. No. 5, Poole Road.

11. No. 17, Wilkinson Street.

12. No. 181, Richards Road.

13. No. 12, Portland Road.

27. The Highways Depot, Wood Lane, Stannington.

28. The Highways Laboratory and Training Centre, Station Road, Ecclesfield.

29. The highways improvement land fronting the engineering works, Greenland Road.

30. The highways improvement land fronting the Bus Garages and Depot at Greenland Road.

31. The highways improvement land situated on Greenland Road between Catley Road and Waterfall Road.

32. The highways improvement land situated on Greenland Road between Waterfall Road and Britannia Road.

33. The highways improvement land situated on Greenland Road between Britannia Road and Catcliffe Road.

34. The highways improvement land between Nos. 253 and 259 (inclusive), Richmond Road.

35. The land shown coloured pink and hatched black on the map prepared by the South Yorkshire County Council which forms part of the Mosborough Parkway, Stage 1, Coisley Hill to Mossway Highway Scheme, and which bears the reference MW/SNI.1/1184.

Explanatory Note

(This note is not part of the Order)

This Order transfers certain properties formerly owned by the South Yorkshire Metropolitan County Council for highways, derelict land, and other purposes to the councils for the districts in which they are situated.

Article 2 transfers property mentioned in the Schedules as follows-

1980 c. 66. On 1st April 1986, by virtue of section 8 of and Schedule 4 to the Local Government Act 1985, metropolitan district councils become highways authorities for their areas, and by virtue of section 263 the highways vested in such councils.
