The Secretary of State for Transport in exercise of the powers conferred by section 14 of the Harbours Act 1964(1) and now vested in him (2) and of all other powers enabling him in that behalf, and on the application of the Portsmouth City Council in accordance with section 7(5) of the Pilotage Act 1987(3), hereby makes the following Order:-
1. This Order may be cited as the Portsmouth (Pilotage) Harbour Revision Order 1988 and shall come into force on 1st October 1988.
2. In this Order -
"the Council" means the Portsmouth City Council;
"the existing area of jurisdiction" means the area comprised in the limits of the Camber Dock, Flathouse Wharf and Mile End Quay undertakings of the Council;
"the signed plan" means the plan signed in triplicate by an Under Secretary in the Department of Transport, two copies of which have been deposited at that Department and one copy of which has been deposited at the offices of the City Secretary and Solicitor of the Council situated at Guildhall Square, Portsmouth, PO1 2AL.
3. The limits within which the Council shall have jurisdiction for the purposes of pilotage under Part I of the Pilotage Act 1987 shall include (in addition to the existing area of jurisdiction) the areas shown hatched red on the signed plan, being:-
(a)so much of Portsmouth Harbour as is situated below the level of high water; and
(b)so much of the area of Spithead outside Portsmouth Harbour as extends from Gilkicker Point Light (latitude 50°46'.4N longitude 1°08'.4W) to No Man's Land Fort Light (latitude 50°44'.4N longitude 1°05'.6W); thence due South (true) to a position on latitude 50°43'.833N; thence due East (true) to Warner Buoy (at longitude 1°03'.917W); thence in a north easterly direction to Horse Elbow Foul Buoy (latitude 50°44'.4N longitude 1°03'.367W) and thence due North (true) to a point on the shoreline (latitude 50°46'.917N longitude 1°03'.367W).

By virtue of section 7(5) of the Pilotage Act 1987 a direction given by a competent harbour authority for the purpose of making pilotage compulsory for ships navigating in a specified area shall not apply to any area which is outside the authority's harbour unless the limits of jurisdiction of the authority for pilotage purposes have been extended to cover that area.
This Order accordingly extends the limits of jurisdiction of the Portsmouth City Council for pilotage purposes under Part I of the Pilotage Act 1987 so as to include an area in respect of which the Council considers that pilotage should be compulsory.
The applicant for this Order is the Portsmouth City Council.
