CHANGES IN LOCAL GOVERNMENT AREAS

Whereas under section 17(1) of the Local Government (Scotland) Act 1973((1)) the Local Government Boundary Commission for Scotland on 10th November 1987 submitted to the Secretary of State a report on a review conducted under section 14(2) of that Act in which they made proposals for the transfer of certain areas between Angus District in Tayside Region and Kincardine and Deeside District in Grampian Region and in which they also made proposals for changes in electoral arrangements consequential on those changes in local government areas;
Now, therefore, in exercise of the powers conferred on him by section 17(2) of the said Act, and of all other powers enabling him in that behalf, the Secretary of State hereby makes the following Order to give effect to the proposals of the Local Government Boundary Commission for Scotland as submitted to him:
1. This Order may be cited as the Tayside and Grampian Regions and Angus and Kincardine and Deeside Districts (River North Esk) Boundaries Amendment Order 1988, and shall come into force on 1st April 1988.
2. In this Order-
"the 1977 Regulations" means the Local Government Area Changes (Scotland) Regulations 1977((2)); and
"boundary map 1" means the map prepared by the Scottish Office, marked "Map 1 of the Tayside and Grampian Regions and Angus and Kincardine and Deeside Districts (River North Esk) Boundaries Amendment Order 1988" and deposited in accordance with regulation 3 of the 1977 Regulations;
"boundary map 2" means the map prepared by the Scottish Office, marked "Map 2 of the Tayside and Grampian Regions and Angus and Kincardine and Deeside Districts (River North Esk) Boundaries Amendment Order 1988" and deposited in accordance with regulation 3 of the 1977 Regulations;
and, in the Schedule to this Order, any reference to a boundary of a region is a reference to a boundary existing immediately before the commencement of this Order.
3. Save insofar as they can have no application in relation to the area changes effected by this Order, the provisions of the 1977 Regulations shall apply in relation thereto for the purposes of, or in consequence of, this Order.
4.-(1) Those areas of Kincardine and Deeside District in Grampian Region, being the Area A and the Area C described in Part I of the Schedule to this Order and shown delineated, hatched and marked "Area A" and "Area C" on boundary map 1, shall be transferred to Angus District in Tayside Region.
(2) Those areas of Angus District in Tayside Region, being the Area B1, the Area B2, the Area D and the Area E described in Part II of the Schedule to this Order and shown delineated, hatched and marked "Area B1" and "Area B2" on boundary map 1 and "Area D" and "Area E" on boundary map 2, shall be transferred to Kincardine and Deeside District in Grampian Region.
5.-(1) Area A described in Part I of the Schedule to this Order (being the Area A transferred by article 4(1) of this Order)-
(a)shall cease to form part of electoral division 53 (Mearns) of Grampian Region((3)) and of ward 9 (Mearns South and St Cyrus) of Kincardine and Deeside District((4)); and
(b)shall form part of electoral division 6 (Montrose North Esk) of Tayside Region((5)) and of ward 11 (Montrose North) of Angus District((6)).
(2) Area C described in Part I of the Schedule to this Order (being the Area C transferred by article 4(1) of this Order)-
(a)shall cease to form part of electoral division 53 (Mearns) of Grampian Region and of ward 9 (Mearns South and St Cyrus) of Kincardine and Deeside District; and
(b)shall form part of electoral division 6 (Montrose North Esk) of Tayside Region and of ward 12 (Hillside) of Angus District.
(3) Area B1 described in Part II of the Schedule to this Order (being the Area B1 transferred by article 4(2) of this Order)-
(a)shall cease to form part of electoral division 6 (Montrose North Esk) of Tayside Region and of ward 11 (Montrose North) of Angus District; and
(b)shall form part of electoral division 53 (Mearns) of Grampian Region and of ward 9 (Mearns South and St Cyrus) of Kincardine and Deeside District.
(4) Area B2 described in Part II of the Schedule to this Order (being the Area B2 transferred by article 4(2) of this Order)-
(a)shall cease to form part of electoral division 6 (Montrose North Esk) of Tayside Region and of ward 12 (Hillside) of Angus District; and
(b)shall form part of electoral division 53 (Mearns) of Grampian Region and of ward 9 (Mearns South and St Cyrus) of Kincardine and Deeside District.
(5) Area D and Area E described in Part II of the Schedule to this Order (being the Area D and Area E transferred by article 4(2) of this Order)-
(a)shall cease to form part of electoral division 6 (Montrose North Esk) of Tayside Region and of ward 12 (Hillside) of Angus District; and
(b)shall form part of electoral division 53 (Mearns) of Grampian Region and of ward 10 (Mearns West and Marykirk) of Kincardine and Deeside District.

Articles 2, 4 and 5
The area bounded by a line commencing at a point on the regional boundary grid reference NO 7380 6239, then downstream following the medium filumof the River North Esk to a point midstream in the river due east of grid reference NO 7380 6270, then directly eastwards to mean low water springs, then generally southwards along mean low water springs to rejoin the existing regional boundary at a point grid reference NO 7408 6207, then generally northwestwards along that regional boundary to the point of commencement.
The area bounded by a line commencing at a point on the regional boundary grid reference NO 7231 6199, then upstream following the medium filumof the River North Esk to rejoin the existing regional boundary at a point grid reference NO 7134 6244 , then southeastwards, eastwards and northeastwards along that regional boundary to the point of commencement.
The area bounded by a line commencing at a point on the regional boundary grid reference NO 7380 6239, then upstream following the medium filumof the River North Esk to rejoin the existing regional boundary at a point grid reference NO 7245 6218, then northeastwards, eastwards and generally southeastwards along that regional boundary to the point of commencement.
The area bounded by a line commencing at a point on the regional boundary grid reference NO 7245 6218, then southeastwards to the midstream point on the River North Esk, then upstream following the medium filumof the river to rejoin the existing regional boundary at a point grid reference NO 7231 6199, then northeastwards along that regional boundary to the point of commencement.
The area bounded by a line commencing at a point on the regional boundary grid reference NO 6766 6609, then upstream following the medium filumof the River North Esk to rejoin the existing regional boundary at a point grid reference NO 6729 6584, then northwards, northeastwards and southeastwards along that regional boundary to the point of commencement.
The area bounded by a line commencing at a point on the regional boundary grid reference NO 6365 6613, then upstream following the medium filumof the River North Esk to rejoin the existing regional boundary at a point grid reference NO 6247 6648, then generally eastwards along that regional boundary to the point of commencement.

This Order transfers areas extending to approximately 156 hectares at the River North Esk between Angus District in Tayside Region and Kincardine and Deeside District in Grampian Region and makes consequential changes to electoral arrangements.
The maps annexed to and forming part of this note give a general guide to the areas affected by this Order as from 1st April 1988.
Copies of the detailed boundary maps defined in article 2 of this Order may be inspected at the offices of any of the local authorities referred to in this Order, and may be inspected at or purchased from the Scottish Development Department's Map Library, New St Andrew's House, St James Centre, Edinburgh, EH1 3SZ.
S.I. 1977/8
The electoral divisions of Grampian Region were constituted by S.I. 1978/882, to which there are amendments not relevant to this Order.
The wards of Kincardine and Deeside District were constituted by S.I. 1980/42
The electoral divisions of Tayside Region were constituted by S.I. 1978/58, to which there are amendments not relevant to this Order.
The wards of Angus District were constituted by S.I. 1980/1680
