The Queen's Most Excellent Majesty in Council

WHEREAS Her Majesty deems it expedient to amend the Royal Warrant of 21st December 1964(1), as amended(2), and the Order of Her Majesty of 22nd December 1964(3), as amended(4), concerning pensions and other grants in respect of disablement or death due to service in the Home Guard(5) and to do so by Order in Council in accordance with section 12(1) and (3) of the Social Security (Miscellaneous Provisions) Act 1977(6):

NOW, THEREFORE, Her Majesty, in exercise of the powers conferred by the said section 12(1) and (3) and of all other powers enabling Her in that behalf, is pleased by and with the advice of Her Privy Council, to order, and it is hereby ordered, as follows:

Citation and commencement

1. This Order may be cited as the Home Guard (Amendment) Order 1989 and shall come into force on 1st September 1989.

Public funds to include reference to community charge

2.-(1) The Warrant of 21st December 1964(7), concerning pensions and other grants in respect of disablement or death due to service in the Home Guard, shall be amended by the inclusion in article 1(6) after the words "general or local rate" of the words "moneys provided under the Abolition of Domestic Rates etc. (Scotland) Act 1987(8)".

(2) The Order of 22nd December 1964(9) concerning pensions and other grants in respect of disablement or death due to service in the Home Guard after 27th April 1952 shall be amended by the inclusion in article 1(6) after the words "general or local rate" of the words "moneys provided under the Abolition of Domestic Rates etc. (Scotland) Act 1987"(10)

Explanatory Note

(This note is not part of the Order)

This Order makes amendments to previous instruments relating to the payment of pensions and other grants in respect of disablement or death due to service in the Home Guard. The amendments are consequential upon the abolition in Scotland of domestic rates and their replacement by the community charge.
