The Local Government and Housing Act 1989 (Commencement No. 2) Order 1989

The Secretary of State in exercise of the power conferred on him by section 195(2) of the Local Government and Housing Act 1989(1), and of all other powers enabling him in that behalf, hereby makes the following Order:

1. This Order may be cited as the Local Government and Housing Act 1989 (Commencement No. 2) Order 1989.

2. The following provisions of the Local Government and Housing Act 1989 shall come into force on November 29, 1989-�

Explanatory Note

(This note is not part of the Order)

This Order brings into force on 29th November 1989 the provisions of section 1(5) and (6) of the Local Government and Housing Act 1989 throughout Great Britain. These subsections enable the Secretary of State to prescribe requirements for restricting the political activities of every person holding a politically restricted post under a local authority and provide that their terms of appointment and conditions of employment shall be deemed to include such requirements.

The Order also brings into force on 29th November 1989 section 2 of that Act which specifies the posts which are to be subject to political restriction and imposes a duty on local authorities to prepare, maintain and deposit with their proper officer, within 2 months of commencement of the section a list of posts for which the annual rate of remuneration is or exceeds £19,500 and posts which involve giving advice on a regular basis to the authority or a committee of the authority or speaking on behalf of the authority on a regular basis to journalists or broadcasters.
