The Local Authorities (Allowances) (Scotland) Amendment Regulations 1990

The Secretary of State, in exercise of the powers conferred on him by sections 45, 49A, 50 and 235(1) of the Local Government (Scotland) Act 1973(1), and of all other powers enabling him in that behalf, hereby makes the following Regulations:

Citation, commencement and interpretation

1.-(1) These Regulations may be cited as the Local Authorities (Allowances) (Scotland) Amendment Regulations 1990 and shall come into force on 1st September 1990.

(2) In these Regulations, "the principal Regulations" means the Local Authorities (Allowances) (Scotland) Regulations 1975(2).

Increase in rates of attendance allowance and financial loss allowance

2. In regulation 3 of the principal Regulations-�

(a)in paragraph (1) (which prescribes the rate of attendance allowance) for "£19.50" there shall be substituted "£21.00"; and

(b)in paragraph (2) (which prescribes the rate of financial loss allowance)-�

(i)in sub-paragraph (a) for "£16.15" there shall be substituted "£17.65", and

(ii)in sub-paragraphs (b) and (c) for "£32.35", where it occurs, there shall be substituted "£35.30".

Increase in rates of special responsibility allowance

3. In paragraph (1) of regulation 3A of the principal Regulations(3) (which prescribes the maximum rate of special responsibility allowance)-�

(a)in sub-paragraph (a) for "£5,580" there shall be substituted "£6,010"; and

(b)in sub-paragraph (b) for "£560" in both places where it occurs there shall be substituted "£605".

4. For every amount specified in column 2 of Schedule 2 to the principal Regulations(4) which is mentioned in column 2 of the Schedule to these Regulations(5), there shall be substituted the amount set opposite thereto in column 3 of the Schedule to these Regulations.

Revocation

5. The Local Authorities (Allowances) (Scotland) Amendment Regulations 1989(6) are hereby revoked.

Explanatory Note

(This note is not part of the Regulations)

These Regulations increase the maximum rate of attendance allowance payable to members of a local authority who are councillors, and the maximum rate of financial loss allowance payable for the performance of an approved duty to members of a local authority and of other bodies who are not entitled to attendance allowance (regulation 2). The Regulations also increase the maximum rates of special responsibility allowance which may be paid by a local authority and increase the total amount which a local authority may pay by way of such allowance in any financial year, depending upon the population of that local authority area (regulations 3 and 4).

These Regulations also revoke the Local Authorities (Allowances) (Scotland) Amendment Regulations 1989 which set the previous maximum rates and totals payable (regulation 5).
