The Minister of Agriculture, Fisheries and Food and the Secretary of State, being Ministers designated(1) for the purposes of section 2(2) of the European Communities Act 1972(2) in relation to any type approval scheme for agricultural or forestry tractors and their components, acting jointly, in exercise of the powers conferred on them by that section and of all other powers enabling them in that behalf, hereby make the following Regulations:
1.-(1) These Regulations may be cited as the Agricultural or Forestry Tractors and Tractor Components (Type Approval) (Amendment) Regulations 1990 and shall come into force on 3rd January 1991.
(2) In these Regulations "the principal Regulations" means the Agricultural or Forestry Tractors and Tractor Components (Type Approval) Regulations 1988(3).
2. In regulation 3(1) of the principal Regulations, in the definition of "agricultural or forestry tractor"-
(a)in sub-paragraph (ii), after the words "specified in" there shall be inserted-
"Article 9 of Council Directive 77/536/EEC(4) or", and
(b)after sub-paragraph (ii), there shall be inserted the following sub-paragraph-
"(iia)in relation to the approval of a tractor in respect of its operating space, access to the driving position and doors and windows means a tractor as defined above and having the characteristic as to track width specified in Article 1.2 of Council Directive 80/720/EEC(5);".
3. In Schedule 2 to the principal Regulations-
(a)in Part A, the reference to Council Directive 75/323/EEC shall be omitted;
(b)in Part A in column 1-
(i)at the end of the reference to Council Directive 77/536/EEC there shall be added-
"and Council Directive 89/680/EEC (OJ No. L398, 30.12.89, p.26)",
(ii)in the reference to Council Directive 78/764/EEC, after the words "Portuguese Republic" there shall be inserted-
"; Council Directive 87/354/EEC (OJ No. L192, 11.7.87, p.43)",
(iii)the reference to Council Directive 86/298/EEC shall be amended by adding-
"as amended by Council Directive 89/682/EEC (OJ No. L398, 30.12.89, p.29)", and
(iv)the reference to Council Directive 87/402/EEC shall be amended by adding-
"as amended by Council Directive 89/681/EEC (OJ No. L398, 30.12.89, p.27)";
(c)in Part B in column 1-
(i)at the end of the reference to Council Directive 77/536/EEC there shall be added-
"and Council Directive 89/680/EEC",
(ii)in the reference to Council Directive 78/764/EEC, after the words "Portuguese Republic" there shall be inserted-
"; Council Directive 87/354/EEC",
(iii)the reference to Council Directive 86/298/EEC shall be amended by adding-
"as amended by Council Directive 89/682/EEC", and
(iv)the reference to Council Directive 87/402/EEC shall be amended by adding-
"as amended by Council Directive 89/681/EEC".

These Regulations, which apply throughout the United Kingdom, further amend the Agricultural or Forestry Tractors and Tractor Components (Type Approval) Regulations 1988. The Regulations implement Council Directives 89/680/EEC (OJ No. L398, 30.12.89, p.26), 89/681/EEC (OJ No. L398, 30.12.89, p.27) and 89/682/EEC (OJ No. L398, 30.12.89, p.29) which amend Directives relating to roll-over protection structures (regulation 3(b)(i), (iii) and (iv) and (c)(i), (iii) and (iv)).
These Regulations also make certain other minor amendments-
(a)the definition of "agricultural or forestry tractor" is amended to include references to two Council Directives which require certain types of test to be carried out on tractors having specified characteristics (regulation 2),
(b)the reference to a Council Directive which has been superseded is omitted from the list of Community Directives (regulation 3(a)), and
(c)reference is made to an amending Council Directive in relation to the testing of drivers' seats (regulation 3(b)(ii) and (c)(ii)).
