The Secretary of State for the Environment, in exercise of the powers conferred on him by sections 8(1) and 15(6) of the Local Government Act 1988(1), and of all other powers enabling him in that behalf, hereby makes the following Regulations:

Citation, commencement and interpretation

1.-(1) These Regulations may be cited as the Local Government Act 1988 (Defined Activities) (Specified Periods) (Inner London) Regulations 1990 and shall come into force on 2nd January 1991.

(2) In these Regulations-

"the Act" means the Local Government Act 1988;

"specified authority" means the council of an inner London borough or the Common Council of the City of London in its capacity as a local authority;

"cleaning" means work falling within the defined activity mentioned in section 2(2)(b) of the Act and consisting of the cleaning of buildings transferred to a specified authority by the Education (Inner London Education Authority) (Property Transfer) Order 1990(2);

"catering" means work falling within the defined activity mentioned in section 2(2)(d) of the Act and consisting of catering for the purpose of schools so transferred;

"ground maintenance" means work falling within the defined activity mentioned in section 2(2)(f) of the Act and consisting of the maintenance of ground so transferred.

Specified periods

2. In the case of a specified authority the second condition, set out in section 7(3) of the Act, shall not be treated as fulfilled as respects any work mentioned in the first column of the Schedule hereto if the period stated in the detailed specification by virtue of section 7(3)(c) is less than the period mentioned in the second column of the Schedule or exceeds the period mentioned in the third column.

Disapplication of previous regulations

3. The Local Government Act 1988 (Defined Activities) (Specified Periods) (England) Regulations 1988(3) shall not apply to work to which these Regulations apply.

Explanatory Note

(This note is not part of the Regulations)

These Regulations specify, for the purposes of Part I of the Local Government Act 1988, the minimum and maximum periods for which inner London borough councils and the Common Council of the City of London may invite offers to carry out certain work in connection with property transferred from the former Inner London Education Authority.
