The Secretary of State for the Environment, in exercise of the powers conferred on him by sections 6(3) and 15(6) and (7) of the Local Government Act 1988(1), and of all other powers enabling him in that behalf, hereby makes the following Regulations:-�

Citation, commencement and interpretation

1. -�

(1) These Regulations may be cited as the Local Government Act 1988 (Competition) (Leeds City Council) (Refuse Collection) Regulations 1991 and shall come into force on 31st December 1991. (2) In these Regulations-�

"the Act" means the Local Government Act 1988;

"the Council" means Leeds City Council;

"specified work" means work falling within the defined activity mentioned in section 2(2)(a) of the Act (collection of refuse);

"the Map" means the map entitled

"Map referred to in the Local Government Act 1988 (Competition) (Leeds City Council) (Refuse Collection) Regulations 1991", copies of which shall be deposited until 1st January 1998 at the office of the Secretary of State for the Environment and at the principal office of the Council.

Application of section 6 of the Act

2.-(1) Section 6 of the Act shall apply to specified work which is proposed to be carried out by the Council on or after 1st January 1998 in the area shown edged red on the Map.

(2) That section shall apply to any specified work which is proposed to be carried out by the Council on or after 1st January 1993 in any other area.

Disapplication of previous regulations

3. Regulation 5 of the Local Government Act 1988 (Defined Activities) (Competition) (England) Regulations 1988(2) shall not apply to specified work which is proposed to be carried out by the Council.

Explanatory Note

(This note is not part of the Regulations)

Section 6 of the Local Government Act 1988 provides that certain authorities may not carry out work falling within certain defined activities on or after a date specified by the Secretary of State unless the work has been subjected to competition.

Regulation 5 of the Local Government Act 1988 (Defined Activities) (Competition) (England) Regulations 1988 specified 1st January 1992 for that purpose in respect of refuse collection work carried out by Leeds City Council.

The effect of these Regulations is to postpone the application of section 6 to 1st January 1998 in respect of refuse collection work carried out by that council in an area of North Leeds shown on the map referred to in the Regulations, and to 1st January 1993 in respect of any other refuse collection work carried out by it.

Copies of the map referred to in the Regulations are deposited, and may be inspected during normal office hours, at the Civic Hall, Leeds LS1 1UR and at the Department of the Environment, 2 Marsham Street, London SW1P 3EB.
