The Secretary of State for the Environment, as respects England, and the Secretary of State for Wales, as respects Wales, in exercise of the powers conferred on them by sections 102(2) and (4), 137(2), 138(1)(1) and 190(1) of the Local Government and Housing Act 1989(2), and of all other powers enabling them in that behalf, hereby make the following Regulations:-
1. These Regulations may be cited as the Housing Renovation etc. Grants (Prescribed Forms and Particulars) (Amendment) Regulations 1991 and shall come into force on1st May 1991.
2.-(1) The forms in the Schedule to the Housing Renovation etc. Grants (Prescribed Forms and Particulars) Regulations 1990(3) are amended in accordance with this regulation.
(2) At the end of question 3.13 in Form 1 (application for renovation grant) and inForm 2 (application for disabled facilities grant) insert the following:

(3) For question 3.38 in Form 1 and in Form 2 substitute-
"

(4) In the first sentence of note 28 in Form 1 and in Form 2 insert after the words "if you", in both places where those words occur, the words "or your partner".
(5) After note 30 in Form 1 and in Form 2 insert the following as note 30A:
"30A. Answer "yes" to this question if you or your partner would be entitled to invalid care allowance but for an overlapping benefit (i.e. injury benefit, unemployability supplement, industrial death benefit, war pension death benefit, and training allowance).".
(6) At the end of question 3.11 in Form 3 (application for common parts grant) insert the following:

(7) For question 3.36 in Form 3 substitute-
"

(8) In the first sentence of note 26 in Form 3 insert after the words "if you" , in both places where those words occur, the words "or your partner".
(9) After note 28 in Form 3 insert the following as note 28A:
"28A. Answer "yes" to this question if you or your partner would be entitled to invalid care allowance but for an overlapping benefit (i.e. injury benefit, unemployability supplement, industrial death benefit, war pensions death benefit, and training allowance).".
(10) In question 2.9 in Form 4 (application for HMO grant) where the sentence "(Go to 2.12)" appears substitute the sentence "(Go to 2.11)".
(11) In question 2.11 in Form 4 where the sentence "(Go to 2.14)" appears substitute the sentence "(Go to 2.13)".
3. In respect of any application for a grant made before 1st May 1991 the provisions of the Housing Renovation etc. Grants (Prescribed Forms and Particulars) Regulations 1990 shall apply as if these Regulations had not come into force.

These Regulations amend the Housing Renovation etc. Grants (Prescribed Forms and Particulars) Regulations 1990. The amendments are consequential upon amendments made by the Housing Renovation etc. Grants (Reduction of Grant) (Amendment) Regulations 1991 (S.I.1991/897) to the Housing Renovation etc. Grants (Reduction of Grant) Regulations 1990 (S.I. 1990/1189) in relation to student loans, the carer premium, voluntary payments and the conditions for applying premiums in respect of the applicable amount.
Regulation 2(2) adds to question 3.13 in Forms 1 (application for renovation grant) and 2 (application for disabled facilities grant) a requirement to state whether invalid care allowance is received. Regulation 2(6) adds to question 3.11 on Form 3 (application for common parts grant) the same requirement. Regulation 2(5) inserts note 30A on Forms 1 and 2 which gives guidance in answering the amended question 3.13. Regulation 2(9) inserts note 28A on Form 3 which gives guidance in answering the amended question 3.11.
Regulation 2(3) adds to question 3.38 in Forms 1 and 2 a requirement to give details of any student loan and further details about charitable income and voluntary payments. Regulation 2(7) adds to question 3.36 in Form 3 the same requirement.
Regulation 2(4) inserts words in note 28 in Forms 1 and 2. Regulation 2(8) inserts the same words in note 26 in Form 3.
Regulation 2(10) and (11) makes minor amendments to correct errors in two questions in Form 4 (application for HMO grant).
Regulation 3 (transitional) provides that the amendments do not apply in respect of any application for a grant made before the date on which the Regulations come into force.
