The Grants to Voluntary Organisations (Specified Date) Order 1992

The Secretary of State, in exercise of the powers conferred on him by sections 48(4A) and 103(1) of the Local Government Act 1985(1), and all other powers enabling him in that behalf, hereby makes the following Order:

Citation, commencement and interpretation

1.-(1) This Order may be cited as the Grants to Voluntary Organisations (Specified Date) Order 1992 and shall come into force on 2nd November 1992.

(2) In this Order "section 48" means section 48 of the Local Government Act 1985.

London scheme: date for approval of total expenditure

2.-(1) This paragraph applies where a scheme made under section 48 in relation to Greater London requires the total expenditure to be incurred under the scheme in any financial year-

(a)in the making of grants; and

(b)in the discharging by the designated council of its functions under the scheme,

to be approved in accordance with the scheme by some or all of the constituent councils.

(2) If paragraph (1) applies, and the total expenditure to be incurred in any financial year beginning in or after 1993 is not approved as required by the scheme before 1st February in the year in which that financial year begins, the constituent councils shall be deemed, subject to any order which has been or may be made under section 48(5), all to have given their approval for that financial year to total expenditure of an amount equal to the amount that was approved or, as the case may be, deemed to have been approved for the preceding financial year.

Explanatory Note

(This note is not part of the Order)

Section 48 of the Local Government Act 1985 enables schemes to be made in relation to Greater London and the metropolitan counties for the making of grants to voluntary organisations. In each such area, one constituent council is designated in the scheme for the purpose of making the grants, with the other councils contributing financially.

In Greater London, the constituent councils are the councils of the London boroughs and the Common Council of the City. By this Order, it is provided that where a scheme which relates to Greater London requires expenditure under the scheme to be approved by some or all of the constituent councils, but the total expenditure in relation to a financial year beginning on or after 1st April 1993 is not so approved before 1st February immediately preceding that financial year, the constituent councils shall be deemed to have given their approval to the amount approved, or deemed to have been approved, for the preceding financial year.
