Her Majesty, in exercise of the powers conferred on Her by section 2(2) of the European Communities Act 1972(1), is pleased, by and with the advice of Her Privy Council, to order, and it is hereby ordered, as follows:

Citation and commencement

1. This Order may be cited as the European Communities (Designation) Order 1994 and shall come into force on 15th April 1994.

Designation of Ministers or departments

2.-(1) For the purposes of section 2(2) of the European Communities Act 1972 the Ministers or government department specified in column (1) of the Schedule to this Order are hereby designated in relation to the matters specified in column (2) of that Schedule.

(2) Where a Minister or government department is designated in relation to any item in column (2) of the said Schedule, then, for the purposes of the said section 2(2), that Minister or government department is also hereby designated in relation to anything supplemental or related to the matters specified in that item.

(3) Where both a Minister and a government department are designated in relation to any matter, the designation has effect as respects the making of regulations by either of them or by both of them acting jointly.

Supersession of earlier designations

3.-(1) The designation which provides that the Secretary of State shall be designated in relation to maritime transport shall supersede the designation of the Secretary of State in relation to requirements concerning sea-going tankers entering or leaving UK ports in the European Communities (Designation) Order 1979(2).

(2) The designation which provides that the Secretary of State and the Treasury shall be designated in relation to measures relating to the interruption or reduction, in part or completely, of economic relations with one or more countries which are not Member States shall supersede the designations of the Secretary of State in relation to the following measures in the following orders:

(a)measures relating to trade affecting Iraq or Kuwait in the European Communities (Designation) (No. 3) Order 1990(3); and

(b)measures relating to claims made under or in connection with contracts or transactions the performance of which has been affected by measures decided upon pursuant to Resolution 661 (1990) of the United Nations Security Council and related resolutions, in the European Communities (Designation) (No. 4) Order 1992(4).

This is a further Order in the series designating Ministers who, and departments which, may exercise powers to make regulations conferred by section 2(2) of the European Communities Act 1972 and specifying the matters in relation to which those powers may be exercised.
