The Secretary of State for Social Security, in exercise of the powers conferred by section 67 and section 68(1) of, and paragraphs 4(4) and 7 of Schedule 5 to, the Disability Discrimination Act 1995(2), and of all other powers enabling him in that behalf, hereby makes the following Regulations:

Citation, commencement and interpretation

1.-(1) These Regulations, which may be cited as the National Disability Council Regulations 1996, shall come into force on 29th January 1996.

(2) In these Regulations "the Council" means the National Disability Council established by section 50 of the Disability Discrimination Act 1995.

Removal from office of a member of the Council

2. The Secretary of State may remove a member of the Council from office in any of the following circumstances-

(a)that he has throughout a continuous period of 6 months ending not earlier than 3 months before the date on which the removal takes effect failed, without the consent of the Council, to attend meetings of the Council;

(b)that he is an undischarged bankrupt or is otherwise unable to pay his debts; and

(c)that he is incapable of discharging the functions of his office or has been guilty of misbehaviour.

Expenses of the Council

3. The Secretary of State may, with the approval of the Treasury, pay expenses of the Council which he is satisfied were reasonably incurred.

Explanatory Note

(This note is not part of the Regulations)

These regulations prescribe the circumstances in which a member of the National Disability Council established by section 50 of the Disability Discrimination Act 1995 may be removed from office by the Secretary of State (regulation 2). They also make provision for the expenses incurred by the Council to be paid by the Secretary of State with the approval of the Treasury (regulation 3).

These Regulations do not impose any costs on business.
