The Cornwall (Coroners' Districts) (Amendment) Order 1996

Whereas the council of the county of Cornwall have, in pursuance of section 4(2) of the Coroners Act 1988(1) and after due compliance with the provisions of the Coroners (Orders as to Districts) Rules 1927(2), submitted to me a draft Order providing for the alteration of the existing division of the said county into coroners' districts:

Now, therefore, in exercise of the power conferred upon me by that section 4(2) and after taking into consideration an objection to the draft made in the prescribed manner and within the prescribed time, I hereby make the following Order:

Citation

1. This Order may be cited as the Cornwall (Coroners' Districts) (Amendment) Order 1996.

Commencement and application

2.-(1) This Order shall come into force on 1st October 1996.

(2) This Order shall not have effect in relation to any inquest begun before the day on which it comes into force or to any post-mortem examination which, before that day, a coroner has directed or requested a medical practitioner to make.

Alteration and renaming of coroners' districts

3.-(1) The existing Number One coroner's district and Number Two coroner's district shall be amalgamated to form new coroner's district to be named the West Cornwall coroner's district.

(2) The existing Number Three coroner's district shall be renamed the East Cornwall coroner's district.

4.-(1) The Cornwall (Coroners' Districts) Order 1974(3) shall accordingly be amended as follows:

(a)in article 3, for the word "three" there shall be substituted the word "two"; and

(b)for the Schedule, there shall be substituted the Schedule to this Order.

(2) The Cornwall (Coroners' Districts) (Amendment) Order 1991(4) is hereby revoked.

Explanatory Note

(This note is not part of the Order)

The county of Cornwall was divided into four coroners' districts by the Cornwall (Coroners' Districts) Order 1974. The amalgamation of two of these coroners' districts into a single new coroner's district by the Cornwall (Coroners' Districts) (Amendment) Order 1991 ("the 1991 Order") reduced the total number of coroners' districts in Cornwall to three.

This Order amalgamates the two coroners' districts unaffected by the 1991 Order to create a single new coroner's district for the districts of Carrick, Kerrier and Penwith, named the West Cornwall coroner's district. The new coroner's district created by the 1991 Order is by this Order renamed the East Cornwall coroner's district. The county of Cornwall is accordingly now divided between the new West Cornwall coroner's district and the renamed East Cornwall coroner's district.
