The Secretary of State for the Environment, as respects England, and the Secretary of State for Wales, as respects Wales, in exercise of the powers conferred on them by sections 61 and 146 of the Housing Grants, Construction and Regeneration Act 1996(1) and of all other powers enabling them in that behalf, hereby make the following Regulations-
1.-(1) These Regulations may be cited as the Group Repair (Qualifying Buildings) Regulations 1996 and shall come into force on 17th December 1996.
(2) In these Regulations, references to sections are references to sections in the Housing Grants, Construction and Regeneration Act 1996.
2. The condition prescribed for a qualifying building for the purposes of section 61(2)(2) (group repair: conditions for qualifying building) is that-
(a)the whole or some part of the exterior of the building is not in reasonable repair, or
(b)the whole or some part of the structure of the building is unstable.
3. The condition prescribed for a primary building for the purposes of section 61(3) (group repair: conditions for primary building) is that the building must comprise at least two dwellings.
4. The conditions prescribed for an additional building for the purposes of section 61(4) (group repair: conditions for additional building) are that-
(a)the building must comprise at least one dwelling; and
(b)carrying out the works to the building and to the primary building at the same time is the most effective way of securing the repair or structural stability of each of them.

These Regulations prescribe the conditions which must be satisfied for qualifying buildings (regulation 2), primary buildings (regulation 3) and additional buildings (regulation 4) for the purposes of group repair schemes under Chapter II of Part I of the Housing Grants, Construction and Regeneration Act 1996.
