The Secretary of State for National Heritage and the Secretary of State for Wales, acting jointly in relation to England and Wales in exercise of the powers conferred by section 1(5) and (6) of the Local Authorities (Goods and Services) Act 1970(1), hereby make the following Order:

Citation and commencement

1. This Order may be cited as the Local Authorities (Goods and Services) (Public Bodies) (English Heritage) Order 1997 and shall come into force on 18th August 1997.

Designation of bodies

2. The Historic Buildings and Monuments Commission for England(2), appearing to the Secretary of State for National Heritage and the Secretary of State for Wales to be exercising functions of a public nature, shall be a public body for the purposes of the Local Authorities (Goods and Services) Act 1970 in its application to England and Wales.

Restrictions on agreements which may be entered into

3. Agreements which may be entered into by the Historic Buildings and Monuments Commission for England by virtue of this Order shall be restricted to agreements with a local authority for the supply of goods or materials, or the provision of administrative, professional or technical services, by that authority to the Historic Buildings and Monuments Commission for England.

Explanatory Note

(This note is not part of the Order)

Article 2 of this Order designates the Historic Buildings and Monuments Commission for England, commonly known as English Heritage, under the Local Authorities (Goods and Services) Act 1970.

The effect of the designation is to allow local authorities in England and Wales to provide goods and materials and administrative, technical and professional services to the Historic Buildings and Monuments Commission for England in connection with the exercise of its functions.
