The Local Government Changes for England (Property Transfer) (Humberside) Order 1997

Whereas the Local Government Residuary Body (England), acting pursuant to article 15 of the Local Government Residuary Body (England) Order 1995(1), has submitted proposals to the Secretary of State for the transfer of certain of its property, rights and liabilities to local authorities:

And whereas the Secretary of State has decided to give effect to those proposals:

Now, therefore, Secretary of State, in exercise of the powers conferred on him by sections 22(3)(a) and 26 of the local Government Act 1992(2), and of all other powers enabling him in that behalf, hereby makes the following Order:

Citation, commencement and interpretation

1.-(1) This Order may be cited as the Local Government Changes for England (Property Transfer) (Humberside) Order 1997 and shall come into force on 1st April 1998.

(2) In this Order, "Humberside property" means property of the Humberside County Council(3) which, on 1st April 1996, vested in the Local Government Residuary Body (England) ("the Residuary Body") by virtue of regulation 6(10) of the Local Government Changes for England (Property Transfer and Transitional Payments) Regulations 1995(4).

Transfer of property

2.-(1) All Humberside property situated in the district of the East Riding of Yorkshire shall vest in the council of that district.

(2) All Humberside property situated in the borough of North East Lincolnshire shall vest in the council of that borough.

(3) All rights or liabilities of the Residuary Body exclusively in respect of any property vested by paragraph (1) or, as the case may be, (2) above shall vest in the council in which the property in question vests.

Explanatory Note

(This note is not part of the Order)

This Order gives effect to proposals made by the Local Government Residuary Body (England) to the Secretary of State for the transfer of property of the former Humberside County Council which vested in that Body on 1st April 1996.

Property is vested in the East Riding of Yorkshire District Council and the North East Lincolnshire Borough Council depending upon the location of the property.

S.I. 1995/401. This Order established the Local Government Residuary Body (England).

Humberside County Council was abolished on 1st April 1996 by S.I. 1995/600.

S.I. 1995/402; regulation 6(9) of these Regulations was amended by S.I. 1995/2796 and 1996/312. There are other amemdments to the Regulations which are not relevant to this Order.
