The Hairmyres and Stonehouse Hospitals National Health Service Trust (Establishment) Amendment Order 1998

The Secretary of State, in exercise of the powers conferred on him by section 12A(1) of and paragraphs 1 and 3(1)(b) of Schedule 7A to the National Health Service (Scotland) Act 1978(1), and of all other powers enabling him in that behalf, hereby makes the following Order:

Citation, commencement and interpretation

1.-(1) This Order may be cited as the Hairmyres and Stonehouse Hospitals National Health Service Trust (Establishment) Amendment Order 1998 and shall come into force on 18th March 1998.

(2) In this Order "the principal Order" means the Hairmyres and Stonehouse Hospitals National Health Service Trust (Establishment) Order 1993(2).

Amendment of Article 3 of the principal Order

2. For article 3 of the principal Order there shall be substituted the following:-�

"3-(1) The trust is established for the purposes specified in section 12A(1)(b) of the Act.

(2) The trust's functions (which include functions which the Secretary of State considers appropriate in relation to the provision of services by the trust for one or more Health Boards) shall be to provide and manage the existing and where appropriate new hospital establishments or facilities known as Hairmyres Hospital, East Kilbride and Stonehouse Hospital, Stonehouse and establishments associated with those hospitals, including management of the facilities provided at and from those establishments, and also including the management of any teaching and research facilities associated with these establishments and the support services related thereto.".

Explanatory Note

(This note is not part of the Order)

This Order substitutes a new article 3 in the Hairmyres and Stonehouse Hospitals National Health Service Trust (Establishment) Order 1993 to empower the trust to provide a new hospital at Hairmyres.

1978 c. 29; section 12A(1) was inserted by the National Health Service and Community Care Act 1990 (c. 19) ("the 1990 Act"), section 31; Schedule 7A was inserted by the 1990 Act, Schedule 6; paragraph 1 of Schedule 7A is cited for the definition of "an order".
