The Housing (Right to Acquire) (Discount) (Amendment) Order 1999

The Secretary of State for the Environment, Transport and the Regions, in exercise of the powers conferred upon him by sections 17(1)(a) and (5) of the Housing Act 1996(1) and all other powers enabling him in that behalf hereby makes the following Order:-

Citation and commencement

1. This Order may be cited as the Housing (Right to Acquire) (Discount) (Amendment) Order 1999 and shall come into force on 2nd December 1999.

Amendment

2. In article 2 of the Housing (Right to Acquire) (Discount) Order 1999(2)-

(a)at the beginning there shall be inserted "-(1) Subject to paragraph (2)";

(b)at the end there shall be added-

"(2) Where the amount of discount under paragraph (1) is greater than 50% of the value of the dwelling house at the relevant time determined in accordance with section 127 of the Housing Act 1985(3), as it applies by virtue of regulation 2(1) of the Housing (Right to Acquire) Regulations 1997(4), the amount of discount shall be 50% of the value so determined of the dwelling house.".

Application

3. This Order does not apply in a case where a notice has been served claiming to exercise the right to acquire before this Order comes into force.

Explanatory Note

(This note is not part of the Order)

This Order amends article 2 of the Housing (Right to Acquire) (Discount) Order 1999 which sets the amount of discount given to tenants purchasing their homes under sections 16 and 17 of the Housing Act 1996 (the right to acquire). The Order provides that the maximum discount a tenant may receive is 50% of the market value of the dwelling house.
