The Secretary of State, in exercise of the powers conferred on him by section 43B(1) of the National Lottery etc. Act 1993(1), and having consulted such persons as appear to him appropriate(2), hereby makes the following Order, a draft of which has been laid before Parliament in accordance with section 60(2)(3) of that Act and approved by a resolution of each House of Parliament:
1. This Order may be cited as the New Opportunities Fund (Specification of Initiatives) Order 1999 and shall come into force on the day after the day on which it is made.
2. For the purposes of section 43B(1) of the National Lottery etc. Act 1993 the initiatives set out in article 3 are specified.
3.-(1) An initiative to improve-�
(a)the prevention, detection, diagnosis and treatment of cancer, including by promoting awareness of, and access to, facilities for preventing, detecting, diagnosing and treating cancer;
(b)the provision of palliative care for persons suffering from cancer; and
(c)the provision to such persons, or to their families or others caring for them, of support and information services associated with such palliative care.
(2) An initiative to help communities to understand, improve and care for their environment (including the living and social environment), which may involve-�
(a)the acquisition of land;
(b)the promotion and management of access to the countryside or to other land which is (or is to be) open to the public; and
(c)the promotion of the use of land for the benefit of the community.
(3) An initiative to promote access to education for persons aged 16 or over, particularly through the development of facilities for providing such access by means of information and communications technology.
(4) In paragraph (3)-�
(a)the reference to the development of facilities includes a reference to the training of persons ("users") in the use of facilities, and to the training of persons to assist or train users; and
(b)the reference to access to education includes a reference to access to information to be used for the purposes of education.

The New Opportunities Fund is a distributor of funds derived from the National Lottery. It may make grants to fund or assist in funding projects, or make or enter into arrangements, which are designed to give effect to such initiatives concerned or connected with health, education and the environment as the Secretary of State may by order specify. This Order, in article 3, specifies three such initiatives, which apply throughout the UK-�
(a)an initiative to improve the prevention, detection, diagnosis and treatment of cancer, the provision of palliative care for persons suffering from cancer, and the provision of support and information services associated with such care;
(b)an initiative to help communities to understand, improve and care for their environment; and
(c)an initiative to promote access to education for persons aged 16 or over, in particular through the development of information and communications technology for that purpose.
These initiatives are in addition to those already specified in the New Opportunities Fund (Specification of Initiatives) Order 1998, S.I. 1998 No. 1598.
1993 c. 39. Section 43B was inserted by section 7(2) of the National Lottery Act 1998 (c. 22).
Section 43C(4) of the National Lottery etc. Act 1993. Section 43C was also inserted by section 7(2) of the National Lottery Act 1998.
Section 60(2) of the National Lottery etc. Act 1993 was amended, so as to include a reference to orders under section 43B of that Act, by section 15(2) of the National Lottery Act 1998. In section 60 of the 1993 Act, a reference to an order is a reference to an order of the Secretary of State: see section 60(6), which was inserted by section 15(6) of the 1998 Act.
