The Secretary of State in exercise of the powers conferred upon him by section 5 of the Building Act 1984(1), hereby makes the following Regulations:

Citation and commencement

1. These Regulations may be cited as the Building Regulations (Amendment) Regulations 2000 and shall come into force on 3rd July 2000.

Amendment of the Building Regulations 1991

2. The Building Regulations 1991(2) shall be amended by inserting the following Part after regulation 9 (exempt buildings and work):-

"PART IIAEXEMPTION OF PUBLIC BODIES FROM PROCEDURAL REQUIREMENTS

The Metropolitan Police Authority

9A.-(1) The Metropolitan Police Authority is hereby prescribed for the purposes of section 5 of the Building Act 1984 (exemption of public bodies from the procedural requirements and enforcement of building regulations).

(2) The Metropolitan Police Authority is exempt from compliance with these Regulations in so far as the requirements of these Regulations are not substantive requirements."

Explanatory Note

(This note is not part of the Regulations)

These Regulations amend the Building Regulations 1991 to exempt the Metropolitan Police Authority from the procedural requirements of those Regulations. Accordingly, the Authority is not exempt from the obligation to comply with the requirements in the Regulations with respect to the design and construction of buildings and the provision of services, fittings and equipment in or in connection with buildings, these being substantive requirements (section 126 of the Building Act 1984).

By virtue of regulation 2 of these Regulations, the Metropolitan Police Authority becomes an exempt body under section 5(2) of the Building Act 1984, and the function of enforcing building regulations conferred on any local authority under section 91(2) of that Act will not be exercisable (section 5(3)). An exempt body prescribed for the purposes of section 5 is also a public body under section 8 (directions dispensing or relaxing building regulation requirements) of that Act.
