Explanatory Note

(This note is not part of the Regulations)

These Regulations amend sections 42(2)(g), 62(5), 63(4) and 66(1) of the Local Government and Housing Act 1989 so as to ensure they are consistent with the principle of additionality in relation to Community structural funds as set out in Article 11 of Council Regulation (EC) No. 1260/1999 which lays down general provisions on the Structural Funds.

The Structural Funds means the European Regional Development Fund, the European Social Fund, the European Agricultural Guidance and Guarantee Fund and the Financial Instrument for Fisheries Guidance.

The amendments have the effect that grants from the Structural Funds towards a local authority's expenditure for capital purposes are treated on the same basis as grants from non-Community sources.

(1)

The Secretary of State was so designated by Article 2(1) of the European Communities (Designation) Order 1999, S.I. 1999/654.

(4)
