LONDON GOVERNMENT

The Greater London Authority (Declaration of Acceptance of Office) Order 2002

  Made 10th April 2002 
  Laid before Parliament 15th April 2002 
  Coming into force 6th May 2002 

The Secretary of State for Transport, Local Government and the Regions, in exercise of the powers conferred upon him by sections 28 and 420(1) of the Greater London Authority Act 1999[1], sections 50(1) and 105(2), (3) and (4) of the Local Government Act 2000[2] and of all other powers enabling him in that behalf, hereby makes the following Order:

Citation, commencement and application
     1.  - (1) This Order may be cited as the Greater London Authority (Declaration of Acceptance of Office) Order 2002 and shall come into force on 6th May 2002.

    (2) This Order applies to the Greater London Authority only.

Form of declaration of acceptance of office
    
2. The declaration of acceptance of the office of - 

shall be in the form in the Schedule to this Order or a form to the like effect.

Revocation of the Greater London Authority (Elections and Acceptance of Office) Order 2000
    
3. The Greater London Authority (Elections and Acceptance of Office) Order 2000[3] shall be revoked.

Amendment to the Local Authorities (Model Code of Conduct) (England) Order 2001
     4.  - (1) In article 4(1) of the Local Authorities (Model Code of Conduct) (England) Order 2001[4], sub-paragraph (g) shall be omitted.

DECLARATION OF ACCEPTANCE OF OFFICE


I [     (1)] having assumed the office of [     (2)] declare that I take that office upon myself, and will duly and faithfully fulfil the duties of it according to the best of my judgement and ability.

I [     (1)] being for the time being Deputy Mayor of London, declare that I take upon myself the office of acting Mayor of London, and will duly and faithfully fulfil the duties of it according to the best of my judgement and ability.

     (1) Insert the name of the person making the declaration.

     (2) Insert "Mayor of London" or "member of the London Assembly" as appropriate.

     (3) Where the declaration is made before another person authorised by section 28(3) of the Greater London Authority Act 1999, state the capacity in which that person takes the declaration[

EXPLANATORY NOTE

(This note is not part of the Order)


This Order prescribes the form of declaration of office for the Mayor of London, members of the London Assembly and any acting Mayor of London in accordance with section 28 of Greater London Authority Act 1999. The declaration must be made within two months of assumption of office.

Article 2 provides that the form (or a form to like effect) in the Schedule to the Order shall be used for such declarations.

Article 3 revokes a previous order made under section 28 of Greater London Authority Act 1999. Article 4 revokes article 4(1)(g) of the Local Authorities (Model Code of Conduct) (England) Order 2001, which disapplies any orders made under section 28 until 27th July 2002.

The Schedule to the Order prescribes the form of the declaration.

When the Greater London Authority adopts a code of conduct for the first time as required by section 51 of the Local Government Act 2000, or where a person becomes a member (as defined by that Act to include the Mayor of London and a London Assembly member) or co-opted member of the Authority at any time after such a code is adopted, he must in addition to the declaration prescribed in this Order (where he is required to make one), give a written undertaking pursuant to section 52 of the Local Government Act 2000 that he will observe the code of conduct.
