LOCAL GOVERNMENT, ENGLAND AND WALES

The Local Government (Best Value) Performance Plans and Reviews (Amendment) (England and Wales) Order 2003

  Made 11th March 2003 
  Laid before Parliament 13th March 2003 
  Coming into force 3rd April 2003 

The First Secretary of State, in exercise of the powers conferred upon him by sections 5(4) and 6(2) of the Local Government Act 1999[1], hereby makes the following Order:

Citation, commencement and application
     1.  - (1) This Order may be cited as the Local Government (Best Value) Performance Plans and Reviews (Amendment) (England and Wales) Order 2003 and shall come into force on 3rd April 2003.

    (2) This Order applies - 

Amendments to Order
     2.  - (1) The Local Government (Best Value) Performance Plans and Reviews Order 1999[3] is amended as follows.

    (2) Articles 3 and 4 are revoked.

    (3) In article 6(1)(f), after "consult", insert "recognised trade unions, organisations representing staff engaged in the exercise of the function, staff engaged in the exercise of the function and".

EXPLANATORY NOTE

(This note is not part of the Order)


This Order amends the Local Government (Best Value) Performance Plans and Reviews Order 1999 "the 1999 Order", which relates to Best Value reviews and performance plans.

Article 2(2) revokes the existing requirements of the 1999 Order as to the matters that must be included in the performance plan that a Best Value authority is required to prepare.

Article 2(3) extends the consultation requirements in article 6 of the 1999 Order to include a requirement on Best Value authorities, in reviewing a function, to consult recognised trade unions and employees' associations representing staff and with staff engaged in that function.
