The Secretary of State for Transport makes this Order in exercise of powers conferred by sections 10 and 12 of the Highways Act 1980[1] and now vested in him[2], and of all other powers enabling him in that behalf: -
1.
This Order may be cited as The A64 Trunk Road (Top Lane Link Road/A1036 Eastbound Exit Slip Road (Part) (Detrunking) Order 2003 and shall come into force on 31st October 2003.
2.
In this Order -
(i) all measurements of distance are measured along the route of the relevant highway;
(ii) "the plan" means the plan numbered HA10/OD/423, marked "The A64 Trunk Road (Top Lane Link Road/A1036 Eastbound Exit Slip Road (Part)) (Detrunking) Order 2003", signed by authority of the Secretary of State for Transport and deposited at DfT, floor 13(IMD), Ashdown House, St Leonards on Sea, Hastings, East Sussex, TN37 7GA;
(iii) "principal road" as a classification for a highway, means that the highway is a principal road for the purposes of enactments and instruments which refer to highways classified as principal roads and is also classified for the purpose of every other enactment and instrument which refers to highways classified by the Secretary of State; and
(iv) "the trunk road" means the Leeds-York-Scarborough Trunk Road (A64).

The length of the trunk road described in the Schedule to this Order shall cease to be a trunk road and shall be classified as a principal road from the date on which this Order comes into force.

SCHEDULE
LENGTH OF THE TRUNK ROAD CEASING TO BE A TRUNK ROAD
The length of the trunk road ceasing to be a trunk road is shown by broad black dashes on the plan and is situated from the point on the A64 Top Lane Interchange eastbound exit slip road centre line, where it intersects with the projected western channel of the link road with Copmanthorpe (marked "A" on the plan) to the end of the central reserve to the north of the junction of the A64 Top Lane Interchange eastbound exit slip road and the A1036 (marked `B' on the plan) to the end of the hatching to the south of the junction of the A64 Top Lane Interchange eastbound exit slip road and the A1036 (marked `C' on the plan) and measures approximately 1 km in length.
