The Secretary of State for Transport makes this Order in exercise of powers conferred by sections 10 and 12 of the Highways Act 1980[1] and now vested in him[2], and of all other powers enabling him in that behalf:
1.
This Order may be cited as the A45 Trunk Road (M1 Junction 16 Roundabout) (Detrunking) Order 2004.
2.
In this Order -
(i) "principal road" as a classification for a highway, means that the highway is a principal road for the purposes of enactments and instruments which refer to highways classified as principal roads and is also classified for the purpose of every other enactment and instrument which refers to highways classified by the Secretary of State; and
(ii) "the trunk road" means the A45 Trunk Road.
3.
The length of the trunk road described in the Schedule to this Order shall cease to be a trunk road and shall be classified as a principal road from the date on which the Secretary of State notifies Northamptonshire County Council that they will become the highway authority responsible for that length of road within their county boundary.

THE SCHEDULE
LENGTH OF THE TRUNK ROAD CEASING TO BE A TRUNK ROAD
The length of the A45 trunk road ceasing to be a trunk road is situated between a point 169 metres west of the traffic island on the west side of the M1 Junction 16 roundabout to a point 50 metres east of the traffic island on the east side of the M1 Junction 16 roundabout and is shown by broad black dashes on the plan folio numbered HA10/TD/013 marked "The A45 Trunk Road (M1 Junction 16 Roundabout) (Detrunking) Order 2004" and signed by authority of the Secretary of State for Transport and deposited at DfT Records Management Branch, Ashdown House, 123 Victoria Street, London SW1 6DE.
