LEGAL SERVICES, ENGLAND AND WALES

The Legal Services Ombudsman (Jurisdiction) (Amendment) Order 2005

  Made 4th March 2005 
  Laid before Parliament 8th March 2005 
  Coming into force 1st April 2005 

The Secretary of State, in exercise of the powers conferred by section 22(11) of the Courts and Legal Services Act 1990[1] and now vested in him[2], makes the following Order:

Citation and commencement
     1. This Order may be cited as the Legal Services Ombudsman (Jurisdiction) (Amendment) Order 2005 and shall come into force on 1st April 2005.

Amendment to the Legal Services Ombudsman (Jurisdiction) Order 1990
    
2. In Part I of the Schedule to the Legal Services Ombudsman (Jurisdiction) Order 1990[3], after "The Chartered Institute of Patent Agents" there shall be inserted "The Institute of Trade Mark Attorneys".

EXPLANATORY NOTE

(This note is not part of the Order)


The Legal Services Ombudsman has jurisdiction under section 22 of the Courts and Legal Services Act 1990 to investigate allegations about the manner in which a complaint made to a professional body has been dealt with by that body. This Order extends that jurisdiction to include the Institute of Trade Mark Attorneys. This is consequent on the Institute becoming authorised to grant rights of audience and rights to conduct litigation to its members under sections 27 and 28 of the 1990 Act by the Institute of Trade Mark Attorneys Order 2005 (S.I. 2005/240).
