PENSIONS

The Pension Protection Fund (Eligible Schemes) Appointed Day Order 2005

  Made 10th March 2005 

The Secretary of State for Work and Pensions, in exercise of the powers conferred upon him by section 126(2) of the Pensions Act 2004[1], and of all other powers enabling him in that behalf, hereby makes the following Order:

     1. This Order may be cited as the Pension Protection Fund (Eligible Schemes) Appointed Day Order 2005.

2. The day appointed for the purposes of section 126(2) of the Pensions Act 2004 (eligible schemes) is 6th April 2005.

EXPLANATORY NOTE

(This note is not part of the Order)


This Order appoints the day for the purposes of section 126(2) of the Pensions Act 2004 (c.35) ("the Act") as 6th April 2005. Subsection (2) of section 126 of the Act provides that the day appointed for the purposes of that subsection is to be the day on or after which an occupational pension scheme is not to be an eligible scheme if, immediately before that day, it is being wound up. Section 126 of the Act makes provision in respect of the occupational pension schemes which are eligible schemes for the purposes of Part 2 of that Act.

A full regulatory impact assessment has not been produced for this instrument as it has no impact on the costs of business.
