The Recreation Grounds (Revocation of Parish Council Byelaws) Order 2005

  Made 21st March 2005 
  Laid before Parliament 22nd March 2005 
  Coming into force 12th April 2005 

Whereas it appears to the First Secretary of State that the byelaws listed in the Schedule to this Order have been substantially superseded by instruments which apply to the area to which the byelaws apply:

     Now, therefore, the First Secretary of State, in exercise of the powers conferred by section 262(8)(d) of the Local Government Act 1972[1], hereby makes the following Order:

Citation, commencement and application
     1.  - (1) This Order may be cited as the Recreation Grounds (Revocation of Parish Council Byelaws) Order 2005 and shall come into force on 12th April 2005.

    (2) This Order applies in relation to England only.

Revocation
    
2. The byelaws mentioned in the left-hand column of the Schedule to this Order, made with respect to the recreation grounds and other areas named or described in the right-hand column of that Schedule, are hereby revoked.

SCHEDULE
Article 2

Parish Council Byelaws Name or description of recreation ground or other area
Byelaws made by the Parish Council of Carterton & Black Bourton on 15th January 1974. Swinbrook Road Recreation Ground, Carterton.
Byelaws made by the Parish Council of Bottesford on 25th June 1968. The park situated in Leys Farm Estate, Bottesford (now known as Greenacre Park).
Byelaws made by the Parish Council of Sundridge on 26th November 1968. Sundridge Playing Field, the Sundridge Memorial Garden, the Ide Hill Recreation Ground and the Goathurst Common Recreation Ground.



EXPLANATORY NOTE

(This note is not part of the Order)


This Order revokes the byelaws specified in the Schedule to the Order, which were made in exercise of the powers conferred on parish councils by section 8(1)(d) of the Local Government Act 1894 (56 and 57 Vict. c. 73). The relevant part of that section was repealed by section 272(1) of, and Schedule 30 to, the Local Government Act 1972. The byelaws continued in force notwithstanding the repeal by virtue of section 262(1) of the 1972 Act. The byelaws are revoked as being substantially superseded by byelaws made under other enactments.

A full regulatory impact assessment has not been produced for this instrument as it has no impact on the costs of business, charities, voluntary bodies or the public sector.

The functions of the Secretary of State under section 262(8)(d) are, so far as exercisable in relation to Wales, transferred to the National Assembly for Wales by article 2 of the National Assembly for Wales (Transfer of Functions) Order 1999 (S.I. 1999/672), to which there are amendments not relevant to this Order; see the entry in Schedule 1 for the Local Government Act 1972.back
