The Royal Parks (Establishment of Eligibility for Transfer and Termination of Employment) Regulations 2005

  Made 12th October 2005 
  Laid before Parliament 13th October 2005 
  Coming into force 10th November 2005 

The Secretary of State makes the following Regulations in exercise of the powers conferred by paragraphs 2 and 8 of Schedule 13 to the Serious Organised Crime and Police Act 2005[1].

Citation and commencement
     1. These Regulations may be cited as the Royal Parks (Establishment of Eligibility for Transfer and Termination of Employment) Regulations 2005 and shall come into force on 10th November 2005.

Establishment of eligibility for transfer
    
2. Every person who, on the date on which these Regulations come into force, is serving as a park constable with the Royal Parks Constabulary shall comply with the requirements set out in regulation 3 for the purposes of establishing whether he is eligible—

     3. —(1) The requirements referred to in regulation 2 are—

as are necessary for the Authority to determine whether the person satisfies the qualifications for appointment to a police force set out in regulation 10(1)(b), (d), (e) and (h) of the Police Regulations 2003[2] (qualifications for appointment to a police force).

    (2) The information required by paragraph (1)(a) shall be provided on or before 25th November 2005.

    (3) If further information is necessary for the Authority to make the determination mentioned in paragraph (1) because the information provided in accordance with paragraph (2) is incomplete or insufficient, or if a medical or eyesight examination is necessary, the further information shall be provided, and the examination shall take place, within a reasonable time after 25th November 2005.

Termination of employment
     4. The following persons shall not be eligible for compensation for early retirement or severance under schemes made under section 1 of the Superannuation Act 1972[3]—

EXPLANATORY NOTE

(This note is not part of the Regulations)


These Regulations impose requirements on persons serving as Royal Parks constables for the purposes of establishing whether they are eligible to be employed by the Metropolitan Police Authority or to serve as Metropolitan Police constables when the Royal Parks Constabulary is abolished under section 161 of the Serious Organised Crime and Police Act 2005. The Secretary of State has power to terminate the Crown employment of any Royal Parks constables who fail to comply with any of these requirements, and the Regulations provide that constables shall not be eligible for compensation for early retirement or severance under the Civil Service Compensation Scheme if their Crown employment is terminated in this way. The Regulations also provide that constables who are eligible to serve as Metropolitan Police constables who do not wish to transfer to the Metropolitan Police shall not be eligible for compensation if their Crown employment is terminated by a transfer scheme.
