The Haringey London Borough Council (Temporary Governing Body) Order 2005

  Made 6th November 2005 
  Laid before Parliament 14th November 2005 
  Coming into force 9th December 2005 

Haringey London Borough Council acting in their capacity as local education authority ("the authority") are to establish a new community school, and wish to make arrangements providing for the constitution of the temporary governing body of the proposed school otherwise than as provided by education legislation;

     The authority has, in accordance with section 4(2) of the Education Act 2002[1] ("the Act"), consulted such persons as appear to them to be appropriate;

     It is the opinion of the Secretary of State, having regard to the matters set out in section 1(2) of the Act, that the implementation by the authority of the provisions of this Order may contribute to the raising of educational standards achieved by children in England;

     In exercise of the powers conferred upon the Secretary of State by section 2(1) of the Act, the Secretary of State for Education and Skills, on the application of the authority, makes the following Order:

Citation and commencement
     1. This Order may be cited as The Haringey London Borough Council (Temporary Governing Body) Order 2005 and shall come into force on 9th December 2005.

Exemption
    
2. Regulation 19 of and paragraph 1 of Schedule 2 to the New Schools (General) (England) Regulations 2003[2] shall not, in respect of the constitution of the temporary governing body of the Haringey Sixth Form Centre, apply to the authority.

Time period
     3. This Order shall have effect until 8th December2008.

EXPLANATORY NOTE

(This note is not part of the Order)


This Order enables Haringey London Borough Council ("the authority") to constitute the temporary governing body of the Haringey Sixth Form Centre otherwise than as provided by education legislation. The New Schools (General) (England) Regulations 2003, as amended ("the Regulations"), provide for the temporary governing body of a proposed community school to consist of certain numbers of temporary governors falling within specified categories. The Regulations also specify that no person shall be qualified to be a temporary governor unless he is aged 18 or over at the date of his election or appointment.

The Order is made under section 2 of the Education Act 2002. Article 2 exempts the authority from the duty to constitute the temporary governing body for the Haringey Sixth Form Centre in accordance with the Regulations and exempts the authority from the requirement that all temporary governors must be aged 18 or over. Article 3 provides that the Order has effect until 8th December 2008.
