The Secretary of State, being designated[1] for the purposes of section 2(2) of the European Communities Act 1972[2] in relation to the common agricultural policy of the European Community, in exercise of the powers conferred upon her by that section[3], makes the following Regulations:
Title and commencement
1.
—(1) These Regulations may be cited as the Hill Farm Allowance (Amendment) Regulations 2006.
(2) These Regulations come into force on 28th March 2006.
Amendment of the definition of "moorland"
2.
—(1) The Hill Farm Allowance Regulations 2006[4] are amended as follows.
(2) In regulation 2(1), in the definition of "moorland", for the words from “"Moorland Map of England 1992"“ to the end of the definition, substitute—
"
"Moorland Map of England 2006" each volume being marked with the number of the volume, dated 13th February 2006, signed on behalf of the Secretary of State for Environment, Food and Rural Affairs and deposited at the offices of the Department for Environment, Food and Rural Affairs at Ergon House, Horseferry Road, London SW1P 2AL;".

EXPLANATORY NOTE
(This note is not part of the Regulations)
These Regulations amend the definition of "moorland" in the Hill Farm Allowance Regulations 2006 ("the principal Regulations"). The principal Regulations defined moorland by reference to the Moorland Map of England 1992. That map was reviewed in 2005 and 2006 and a new map, called the "Moorland Map of England 2006", was compiled. The definition of "moorland" in the principal Regulations is accordingly amended by these Regulations to refer to the Moorland Map of England 2006.
A full regulatory impact assessment has not been produced for this instrument as it has no impact on the costs of business.
