The Stebbing Green (Revocation of Parish Council Byelaws) Order 2007

  Coming into force 13th December 2007 

It appears to the Secretary of State that the byelaws specified in article 2 of this Order have been substantially superseded by an instrument which applies to the area to which the byelaws apply.

     Accordingly, the Secretary of State makes the following Order in exercise of the powers conferred by section 262(8)(d) of the Local Government Act 1972[1].

Citation and commencement
     1. This Order may be cited as the Stebbing Green (Revocation of Parish Council Byelaws) Order 2007 and shall come into force on 13th December 2007.

Revocation
     2. The byelaws made by Stebbing Parish Council on 26th June 1952 with respect to Stebbing Green are revoked.

EXPLANATORY NOTE

(This note is not part of the Order)


This Order revokes the byelaws which were made with respect to Stebbing Green in exercise of the powers conferred on parish councils by section 8(1)(d) of the Local Government Act 1894 (56 and 57 Vict. c.73) and section 164 of the Public Health Act 1875 (c. 55). The relevant part of section 8(1)(d) of the Local Government Act 1894 was repealed by section 272(1) of, and Schedule 30 to, the Local Government Act 1972. The byelaws continued in force, notwithstanding the repeal, by virtue of section 262(1) of the 1972 Act. The byelaws are revoked as being substantially superseded by byelaws made under other enactments.

A full regulatory impact assessment has not been produced for this instrument as it has no impact on the costs of business, charities, voluntary bodies or the public sector.

 [1] 1972 c.70. These powers are now vested in the Welsh Ministers so far as they are exercisable in relation to Wales. They were previously transferred to the National Assembly for Wales by article 2 of the National Assembly for Wales (Transfer of Functions) Order 1999 (S.I. 1999/672); see the entry in Schedule 1 to the Local Government Act 1972. By virtue of paragraphs 30 and 32 of Schedule 11 to the Government of Wales Act 2006 (c. 32), they were transferred to the Welsh Ministers.back
