The Police and Justice Act 2006 (Commencement No. 9) Order 2008

24th September 2008

The Secretary of State makes the following Order in exercise of the powers conferred by section 53(1) of the Police and Justice Act 2006(1):

Citation and Extent

1.–(1) This Order may be cited as the Police and Justice Act 2006 (Commencement No. 9) Order 2008.

(2) Article 2 of this Order extends to England, Wales and Northern Ireland.

(3) Article 3 of this Order extends to Northern Ireland.

Commencement: England, Wales and Northern Ireland

2. The following provisions of the Police and Justice Act 2006 shall come into force on 1st October 2008–

(a) sections 35 to 38 (computer misuse)(2);

(b) section 52 (amendments and repeals) in so far as it relates to the provisions in sub-paragraph (c) and the entries in Schedule 15 in sub-paragraph (d);

(c) paragraphs 2, 6, 17 to 24, 26, 27 and 29 of Schedule 14 (minor and consequential amendments)(3); and

(d) in Part 4 of Schedule 15 (repeals and revocations) the entries relating to–

(i) sections 11, 12, 14, 16 and 17 of the Computer Misuse Act 1990(4);

(ii) Schedule 4, paragraph 7 and Schedule 8, paragraph 347 to the Courts Act 2003(5); and

(iii) Schedule 16, paragraph 7 to the Serious Organised Crime and Police Act 2005(6).

Commencement: Northern Ireland

3. The following provisions of the Police and Justice Act 2006 shall come into force on 1st October 2008–

(a) section 52 in so far as it relates to the provision in sub-paragraph (b); and

(b) paragraph 28 of Schedule 14.

This Order brings into force those provisions of the Police and Justice Act 2006 set out in articles 2 and 3 on 1st October 2008.
