The Council of the City of Portsmouth ("the authority"), being a qualifying body for the purposes of Chapter 1 of Part 1 of the Education Act 2002(1) ("the Act"), have, in accordance with section 4(2) of the Act, consulted such persons as appear to them to be appropriate;
It is the opinion of the Secretary of State for Education pursuant to section 1(1)(a) of the Act, having regard to the matters set out in section 1(2), that the extension of the period for which the Harbour School Order 2007(2) has effect may contribute to the raising of educational standards in England;
The Secretary of State, in exercise of the powers conferred by sections 2(1) and 3(1)(a)(iii) of the Act, on the application of the authority, makes the following Order(3):
1. This Order may be cited as the Harbour School (Amendment) Order 2010 and comes into force on 15th December 2010.
2. In article 10 of the Harbour School Order 2007 (time period) for "16th December 2010" substitute "16th December 2013".

This Order is made under sections 2 and 3 of the Education Act 2002 and amends the Harbour School Order 2007 ("the 2007 Order") to provide that the 2007 Order is extended and will cease to have effect on 16th December 2013.
2002 c.32. Chapter 1 of Part 1 has been amended by paragraph 71 of Schedule 14 and Part 1 of Schedule 16 to the Education and Inspections Act 2006 (c.40) and by paragraph 14 of Schedule 1 to the Education and Skills Act 2008 (c.25).
Section 3(2) provides that an order made under section 2 by virtue of subsection (1)(a)(iii) of section 3 may, on one occasion only, extend the period for which a previous order under section 2 has effect by a period of not more than three years from the end of the period originally specified in the previous order.
