The Secretary of State(1), having received an application under section 97 of the Humber Bridge Act 1959, having given notice in accordance with that Act, having considered the representations received and having received no objection, makes this Order in exercise of the powers under that section.
1. This Order may be cited as the Humber Bridge Board (Membership) Order 2012 and comes into force on 31st May 2012.
2.-(1) The following alterations are made to the number of constituent authorities, the number of members to be appointed by the constituent authorities and to the total number of members of the Board(2)-
(a)the number of constituent authorities is reduced by the removal of Lincolnshire County Council(3);
(b)the number of constituent authorities is increased by the addition of North East Lincolnshire Council;
(c)each constituent authority is to appoint one member to the Board; and
(d)the total number of members of the Board appointed by constituent authorities is four.
(2) In consequence of the alterations made by paragraph (1), section 17 of the Humber Bridge Act 1959 (special meetings of the Board) is to be read as if the reference to three or more members of the Board were a reference to two or more members of the Board.

This Order makes changes to the Humber Bridge Board ("the Board"). By this Order, the number of constituent authorities (the local authorities authorised to appoint members to the Board) is altered, firstly by the removal of Lincolnshire County Council as a constituent authority and then by the addition of North East Lincolnshire Council as a constituent authority. This Order also reduces the number of members each constituent authority can appoint to the Board to one. In consequence, this Order also reduces the total number of members of the Board appointed by constituent authorities to four. This Order makes a consequential amendment to the number of members who can convene a special meeting of the Board by reducing it to two.
The functions of the Minister of Transport and Civil Aviation under the Humber Bridge Act 1959 (c.xlvi) are now exercisable by the Secretary of State by virtue of article 2(2) of the Transfer of Functions (Transport) Order 1981 (S.I. 1988/238).
Section 4(2) of the Humber Bridge Act 1959 defines "the Board", "constituent authority" and "the Minister".
The Local Authorities etc (Miscellaneous Provision) (No 2) (Order) 1974, S.I. 1974/595 inserted a new section 6 into the Humber Bridge Act 1959 containing new names of constituent authorities, including Lincolnshire County Council.
