1. This Order may be cited as the Registration of Births, Deaths and Marriages (Fees) (Amendment) Order 2012 and shall come into force on 1st April 2012.
2.-(1) Omit article 1, sub-paragraph (2)(a) of the Registration of Births, Deaths and Marriages (Fees) Order 2010(3).
(2) For article 1, sub-paragraph (2)(d) of that Order substitute-
"a "priority service" is a service provided to a person who, by paying the correct fee and giving the relevant information, makes an application to the Registrar General by 1600 hours on any working day and which is normally provided on or before the next working day by sending by first class post or to a person attending in person at the General Register Office between 1000 hours and 1600 hours;".
(3) For article 1, sub-paragraph (2)(e) of that Order substitute-
"a "standard service" is a service provided to a person who, by paying the correct fee and giving the relevant information, makes an application to the Registrar General by 1600 hours on any working day and which is normally provided either-
in a case where that application includes a reference number relating to an index kept by the Registrar General under section 65(1) of the 1949 Act or section 30(1) or (1A)(4) of the 1953 Act on or before the 4th working day after the working day on which such application is made; or
in a case where that application does not include such a reference number on or before the 15th working day after the working day on which such application is made
by sending by second class post or to a person attending in person at the General Register Office between 1000 hours and 1600 hours;".
3. For article 2 of that Order substitute-
"The fee payable is the relevant fee in the fourth column of the Schedule to this Order.".

This Order amends the Births, Deaths and Marriages (Fees) Order 2010 by replacing the Schedule to that Order, which sets out the fees payable, with a new schedule that includes a number of amendments to the fees payable under the Acts relating to the registration of births, deaths and marriages and associated matters from 1 April 2012. Both the old and the new fees are set out in the Schedule.
Of the forty-four fees included in this Order, twenty-three have remained unchanged, eighteen have increased, two have been divided into a new lower fee for house-bound applicants and a new higher fee for detained applicants and one has been divided into three fees, two new higher fees for registered buildings and detained applicants and one lower fee for house-bound applicants.
Two different types of service, set out in the second column of the Schedule, are available in respect of the provision of a certified copy of entry obtained from the Registrar General following a search of indexes kept at the General Register Office under section 65(2)(c) of the Marriage Act 1949 or section 30(2)(c) of the Births and Deaths Registration Act 1953, and the provision of a short certificate of birth obtained from the Registrar General where that certificate is compiled from a certified copy of an entry in the register of live-births, or from any other records and registers in the custody of the Registrar General, under section 33(1) of the Births and Deaths Registration Act 1953.
A "priority service" is a service under which a person may apply to the Registrar General by 1600 hours on any working day and the certified copy of entry, or short certificate of birth as the case may be, will normally be provided to that person on or before the following working day by sending by first class post or between 1000 hours and 1600 hours where he attends at the General Register Office in person. A "standard service" is a service under which a person may apply to the Registrar General by 1600 hours on any working day and the certified copy of entry, or short certificate of birth as the case may be, will normally be provided to that person by sending by second class post or between 1000 hours and 1600 hours where he attends at the General Register Office in person either-(i) on or before the 4th working day after the working day on which the application was made where a reference number which relates to an index kept by the Registrar General under section 65(1) of the Marriage Act 1949 or section 30(1) or (1A) of the Births and Deaths Registration Act 1953 has been provided with that application; or (ii) on or before the 15th working day after the working day on which the application was made where such a reference number is not provided. A working day in this context excludes a Saturday or Sunday, Christmas Day, Good Friday, and a bank holiday under the Banking and Financial Dealings Act 1971 in England and Wales.
A full impact assessment has not been produced for this instrument as no impact on the private or voluntary sectors is foreseen.
Functions previously conferred on the" Chancellor of the Exchequer" were transferred by the second column of paragraphs 1 and 2 of Schedule 3 to the Public Expenditure and Receipts Act 1968 (c. 14) articles 3(1) and 5(1) of, and paragraph 10 of Schedule 1 and paragraph 16 of Schedule 2 to, the Transfer of Functions (Registration and Statistics) Order 1996 (S.I. 1996/273); and references to the "Secretary of State" were subsequently substituted in the second column of paragraphs 1 and 2 of Schedule 3 to that Act by articles 3(1) and 5(1) of, and paragraph 8 of Schedule 1 and paragraph 8 of Schedule 2 to, the Transfer of Functions (Registration) Order 2008 (S.I. 2008/678).
1968 c. 14. Paragraph 1 of Schedule 3 was amended by section 4 of, and paragraph 5 of Schedule 2 to, the Social Security (Consequential Provisions) Act 1992 (c. 6); and by section 582(1) of, and paragraph 14 of Schedule 37 to, the Education Act 1996 (c. 56). Under section 2(2) of the Marriage Act 1983 (c. 32) the reference to the Marriage Act 1949 (c. 76) in Schedule 3 includes a reference to that Act as amended by the Marriage Act 1983. Other changes have been made which are not relevant to this Order.
Subsection (1A) was inserted by section 108(1) of, and paragraph 13(4) of Schedule 3 to, the Children Act 1975 (c.72).
1887 c.40. Section 10 was amended by section 94 of, and Part III of Schedule 6 to, the Post Office Act 1969 (c. 48), and by Section 4(3) and 7(3) of, and Schedule 4 to, the Trustee Savings Banks Act 1985 (c.58). Section 10 is applied, for the purposes of thee following Regulations, by the following respective provisions regulation 21 of the Savings Contracts Regulations 1969 (S.I. 1969/1342), regulations 25 of the Premium Savings Bonds Regulations 1972 (S.I. 1971/765), regulation 52 of the National Savings Stock Register Regulations 1976 (S.I. 1976/2012), regulation 26 of the Savings Certificates (Yearly Plan) Regulations 1984 (S.I.1984/779), regulation 26 of the Savings Certificates Regulations 1991 (S.I.1991/1031), and regulation 23 of the Savings Certificates (Children's Bonus Bonds) Regulations 1991 (S.I. 1991/1407).
Section 27(7) was inserted by section 1(7) of, and paragraph 5(c) of Schedule 1 to, the Marriage Act 1983.
Section 31(5F) was inserted by secti0n 160(6) of the Immigration Asylum Act 1999 (c.33), and amended by articles 3(1) and 5(1) of, and paragraph 5(5) of Schedule 1 and paragraph 5(1)(b) of Schedule 2 to, the Transfer of Functions (Registration) Order 2008.
Section 51(1) was numbered as such by section 1(7) of, and paragraph 15 of Schedule 2 to, the Transfer of Functions (Registration) Order 2008.
Section 51(2) was inserted by section 1(7) of, and paragraph 15 of Schedule 1 to, the Marriage Act 1983.
Section 57(4) was amended by section 251 of, and paragraph 40 of Schedule 29 to, the Local Government Act 1972 (c.70).
Subsection (1), to which section 124(3) refers, was amended by section 41(4) of, and paragraph 59 of Schedule 2 to, the Jobseekers Act 1995 (c.18), by section 14 of, and paragraphs 8 and 13 of Schedule 2 to, the State Pension Credit Act 2002 (c.16, and by section 28(1) of, and paragraph 10(1) and (16) of Schedule 3 to, the Welfare Reform Act 2007 (c.5).
