The Secretary of State for Health in exercise of the powers conferred by paragraph 2 of Schedule 13 to the Local Audit and Accountability Act 2014(1) makes the following Order.
1. This Order may be cited as the Local Audit and Accountability Act 2014 (Independent Trustees) Amendment Order 2015 and comes into force on 1st April 2015.
2.-(1) Schedule 13 to the Local Audit and Accountability Act 2014 is amended as follows.
(2) In paragraph 3(1)(b), (trustees for NHS trusts, appointed under paragraph 10 of Schedule 4 to the National Health Service Act 2006(2)) after "2006" insert-
", if the trust for which they are trustees is not a charitable trust.".
(3) In paragraph 3(2), at the end of the inserted paragraph 24B insert-
"NOTE: This Act applies to trustees for an NHS trust appointed under paragraph 10 of Schedule 4 to the National Health Service Act 2006 only if the trust of which they are trustees is not a charitable trust.".

This Order amends paragraphs 3(1)(b) and 3(2) of Schedule 13 to the Local Audit and Accountability Act 2014 so that the Act only applies to trustees for an NHS trust appointed under paragraph 10 of Schedule 4 to the NHS Act 2006 if the trust of which they are trustees relates to non-charitable matters.
A full Impact Assessment has not been produced for this instrument as no impact on the private or voluntary sectors is foreseen.
