The Secretary of State makes the following Regulations in exercise of the powers conferred by section 213 of the Housing and Planning Act 2016(1):
1.-(1) These Regulations may be cited as the Housing and Planning Act 2016 (Consequential Provisions) (England) Regulations 2017 and come into force on 6th April 2017.
(2) These Regulations apply to the disposal of property in England only.
2. In rule 183A of the Land Registration Rules 2003(2), omit paragraph (1A).
3.-(1) Schedule 4 of the Land Registration Rules 2003(3) is amended as follows.
(2) In form W-
(a)omit (a);
(b)in (b) for "any other" substitute "a"; and
(c)before "to that disposition" insert "where consent"; and
(d)for "under" substitute "is required by".
(3) In form X-
(a)omit (a);
(b)in (b) for "any other" substitute "a";
(c)before "to that disposition" insert "where consent"; and
(d)for "under" substitute "is required by".
(4) In form Y omit-
(a)"or private registered provider of social housing"; and
(b)"(as modified, in the case of a private registered provider of social housing, by section 179 of the Housing and Regeneration Act 2008)"(4).
(5) In form KK-
(a)after "lease", insert "of property in Wales";
(b)omit "[choose whichever bulleted clause is appropriate]"; and
(c)omit "the Regulator of Social Housing".

These Regulations amend the Land Registration Rules 2003 (S.I. 2003/1417) as a result of the repeal of the consent regime made by Schedule 4 to the Housing and Planning Act 2016 (c. 22).
Regulation 2 revokes paragraph (1A) of rule 183A, which requires a private registered provider of social housing who applies for registration as the proprietor or a registered estate or registered charge to include a statement to that effect, and regulation 3 makes amendments to the relevant obligatory forms of restriction set out in Schedule 4 to the Land Registration Rules 2003.
An impact assessment has not been produced for this instrument as no, or no significant, impact on the private, voluntary or public sectors is foreseen.
S.I. 2003/1417. Rule 183A was inserted by S.I. 2008/1919.
Schedule 4 was substituted by rule 4 of S.I. 2008/1919 and forms W, X, Y and KK were substituted by paragraphs 31 and 33 of Schedule 1 to S.I. 2010/671.
