The Financial Guidance and Claims Act 2018 (Commencement No. 6) Regulations 2019

28th March 2019

The Treasury, with the consent of the Lord Chancellor for the commencement of section 33 of the Financial Guidance and Claims Act 2018(1), make the following Regulations in the exercise of the powers conferred by section 37(5), (9)(b)(ii) and (10) of that Act.

Citation

1.  These Regulations may be cited as the Financial Guidance and Claims Act 2018 (Commencement No. 6) Regulations 2019.

Commencement

2.  The following provisions of the Financial Guidance and Claims Act 2018 come into force on the day after the day on which these Regulations are made-

(a)section 28 (power of FCA to make rules restricting charges for claims management services);

(b)section 33 (legal services regulators' rules: charges for claims management services); and

(c)section 34 (extension of power of the Law Society of Scotland to make rules).

EXPLANATORY NOTE

(This note is not part of the Regulations)

Regulation 2 of these Regulations commences sections 28, 33 and 34 of the Financial Guidance and Claims Act 2018 (c.10) on the day after the day on which these Regulations are made.

The Lord Chancellor's consent was required to commence section 33 in accordance with section 37(10) of the Financial Guidance and Claims Act 2018.

A full impact assessment has not been produced for these Regulations as they have no, or no significant, impact on the costs of business or the voluntary sector. A full impact assessment has been produced in relation to the provisions of the Financial Guidance and Claims Act 2018 (c. 10), including the provisions that are commenced by these Regulations, and a copy is available at https://publications.parliament.uk/pa/bills/lbill/2017-2019/0001/financial-guidance-and-claims-IA1.pdf.
