The A2 Trunk Road (Thanington Westbound Off Slip) (Detrunking) Order 2022

The Secretary of State for Transport makes this Order in exercise of powers conferred by sections 10(2) and 12(3) of the Highways Act 1980( 1) and now vested in the Secretary of State( 2):-

In accordance with section 10(2) of that Act, the Secretary of State has taken into consideration the requirements of local and national planning, including the requirements of agriculture, as is satisfied as to expediency.

This Order is made in compliance with the provisions of Parts I and III of Schedule 1 of that Act.

1.  This Order may be cited as the A2 Trunk Road (Thanington Westbound Off Slip) (Detrunking) Order 2022 and shall come into force on 23rd June 2022.

2.  In this Order all measurements of distance are measured along the route of the relevant highway.

(a) the trunk road” means the length of the A2 Trunk Road westbound off slip in the Parish of Thanington Without, in the District of Canterbury City Council, in the County of Kent described in the Schedule to this Order;

(b) National Highways” means National Highways Company Limited, which is a strategic highways company (Company No 9346363) registered in England and Wales and whose Registered Office is Bridge House, 1 Walnut Tree Close, Guildford, Surrey, GU1 4LZ;

(c) the plan” means the plan numbered 37827/2001/005 marked “The A2 Trunk Road (Thanington Westbound Off Slip) (Detrunking) Order 2022” signed by authority of the Secretary of State for Transport and deposited at Deposited Document Services, One Priory Square, Priory Street, Hastings, East Sussex, TN34 1EA; and

(d) “principal road” as a classification for a highway, means that the highway is a principal road for the purposes of enactments or instruments which refer to principal roads and is also a classified road for the purpose of every enactment and instrument which refers to highways classified by the Secretary of State.

3.  The length of the trunk road described in the Schedule to this Order and shown by parallel hatching on the plan shall cease to be a trunk road and shall be classified as a principal road from the date on which this Order comes into force.

Regulation 3

SCHEDULE LENGTH OF THE TRUNK ROAD CEASING TO BE A TRUNK ROAD

The length of the trunk road ceasing to be a trunk road is shown by parallel hatching on the plan and is a length of the A2 Trunk Road Westbound Off Slip from a point 2 metres south of the channel line of the junction with the A28 carriageway, for a distance of 213 metres in a generally south easterly direction.

EXPLANATORY NOTE

(This note is not part of the Order)

This Order removes the trunk road status from the length of the A2 Trunk Road Westbound Off Slip described in the Schedule to the Order, it will become the A2 principal road with responsibility for it transferred to the local highway authority, Kent County Council.

The detrunked section of highway will provide access to the Thanington Park development, with a replacement Westbound Off Slip provided from the A2 Trunk Road.
